My interview was Wednesday 07/29/2009. Luckily everything went alright or at least as i have planned. after interview the I/O told me a decision can not yet be made about my application. He told me the reason being that I had filed my '08 tax as married filing separate for this year. i then explained to him why I could not file my taxes this year with my wife. (she has been incarcerated for parole violation) i asked if there is anything i can do to expedite the process, he told me he is going to need an input from a supervisor. He printed a transcript of the interview and asked me to read and sign and I did. he then provided a copy of the N-652 with a check mark on *a decision can not yet be made about your application"
If anyone has an idea or experience, please feel free to share

Denied

I had interview yesterday. passed civics and english test and since i had recent DUI (my first offence and not even a misdemenor in wisconsin) she said that it will be reviewed by supervisor and will send me a written desicion in mail with in 60 days. she was very soft spoken and polite. moral of the story is do not break the law, it can bite you back any time.

You'll probably get denied if your application is based on the 3-year marriage rule. You need to be living together with your spouse unless you have an acceptable reason for the separation, and I don't think your spouse's incarceration is an acceptable reason.

I agree with Jackolantern. 3-year rule is very strict rule. There is a bright side: you may re-apply based on 5-year rule.

You haven't been denied yet. We have seen cases here of DUI where the person has been approved, they do that to everyone that has an arrest or a case that needs to be reviewed. So don't lose your hope yet until you see the letter from them.

Incarceration may quality as involuntary separation under 8 CFR(b)(C), but the OP hasn't returned since July so I guess we'll never know if he was denied.

It was two months ago. I paid fine and enrolled for AA as well. In WI First offence DUI is not a misdemeanor it is regulatory offence. No probation or community service.
