Citizen child applying for mother (overstayed B-2 visa / expired I-94)

I just became a US citizen and want to petition permanent residency for my mother who overstayed B-2 visa for over 10 years (expired I-94). She has never left US and been paying taxes.

Would there be any issues because she's here now illegally?
Is there a fine she'll need to pay?
How long does the GC process take for this case?
Anyone had/have similar case as mine?

Thanks all in advance!

Contact an Immigration Attorney whenever there are 'out of status' or 'being here in the U.S illegally' cases.

Don't think there is a fine to pay. Look thro' the message board for timelines.

How did she pay taxes when she got no SSN and can't work?

To pay taxes you don’t need SSN. Anyone can pay taxes by using TIN. I don’t know how she had income. But anyone can pay taxes for any source of income like winning lottery, income from saving account, stocks etc…

No penalty/fine is required. The process is straight-forward; she just MUST NOT LEAVE THE US UNDER ANY CIRCUMSTANCES UNTIL THE GC IS APPROVED.

A lawyer is not required.

Immediate category, no overstaying penalty for GC. Well, this is why some countries never get B2 visa for single moms/poor parents etc.

Is there a penalty for USC's immediate relative ( Mother) for illegal entry into USA?

One cannot AOS, even if immediate relative, if one did not enter the country through lawful admission.

Thank Goodness!!!

The last thing I want to see on TV is running moms trying to enter into US from mexican borders and cowboys on horses running after them with guns in hand. :-)

Is there a penalty for USC's immediate relative ( Mother) for illegal entry into USA?

A father of a friend of mine (legally entered US) for some reason received a deportation letter before his citizen daughter applied permanent residency. He had to pay about $1000 fine and still was able to receive a GC in 6 month.

I don't know what happens to an immediate relative of a citizen who entered US illegally. Anyone know an answer to this?

Anywho, I guess I don't need a lawyer since my mother entered US legally (B2 visa). Every process should be smooth all the way!

Thanks all of you for answering! This forum ROCKS!
