+1 for good guys

Wife just called. We are in receipt of my Oath Letter.

Sent the legal threats on Oct. 30 to the following places:

DENISE FRAZIER
USCIS DISTRICT DIRECTOR
2150 PARKLAKE DRIVE NE
ATLANTA, GA 30345

DHS / USCIS
Office Of The Chief Counsel
20 MASSACHUSETTS AVE NW
SUITE 4025
WASHINGTON, DC 20529

ATTN: CIVIL DIVISION
SALLY Q. YATES, USA
600 US COURTHOUSE
75 SPRING ST SW
ATLANTA, GA 30303-3309

CIS OMBUDSMAN
ATTN: CASE PROBLEMS
MAIL STOP 1225
WASHINGTON, DC 20528

Also sent a copy to the Officer in Charge, in other words the guy who interviewed me, at the 2150 Parklake Dr place.

The nastygram included a draft 1447(b) complaint/petition, a warning letter based on a template I found on this forum, a copy of N-652, and in the Ombudsman mail I also added a Form 7001.

After that it took them less than two weeks to wake up and smell the coffee.

Many thanks to all the people who posted their experiences, especially the guys who compiled the information on the main lawsuit thread.

The oath in on Nov. 30.

 IBIS – Interagency Border Inspection System
 IAFIS –Integrated Automated Fingerprint Identification System
 IDENT – Automated Biometric Identification System
 FBI National Name Check Program

These are the types of background checks. FBI Name check is the one that takes long or the IBIS. I have been told that my FBI Name check has cleared and 3rd Agency check is pending. I assume its the IBIS as IAFIS and IDENT clear within 48 hours. I'm in the same boat as you. I Applied in Jan 2008, got my FP in Feb 2008, got Interviewed on Nov 13th, 2008 with N652 saying no decision. I was asked to submit tax documents for the last 5 years. Docs were submitted on Nov 17th, 2008. Have not hear anything as of yet. I'm still waiting too.

I have a question for you NOCITIZ.... where did you find out how far the FBI checks have come to? I called the FBI fingerprint folks and they said they had cleared. Now, how can I find out about the Name Check?? Who can I call for that? The USCIS folks have said that's where my hold up is and it's been over a year for my N-400!

LAZYCIS, now I was under the impression that 'Pro Se' would be the way to go for me too, but I hear you say that this is the way to go AFTER you've had the interview. I haven't. My status is that I filed for the N-400 14th Oct 2008. More than a year later on 26th Oct 2009 I had my FPs done. I've heard nothing since from them and call them often to find out what is going on. Now, how can I file WOM myself? I've read the sticky above after after doing so, I went to the courthouse today and got all the forms - but I think it's the 'Pro Se' packet that I have. What do I need for the WOM?

USCIS can tell you status of name check. If the name checks are pending for more than several months then file WOM.

I think it's the 'Pro Se' packet that I have. What do I need for the WOM?

Pro Se means you are filing yourself without a lawyer. You can file any case AFAIK like that. But WOM is more complicated than 1447(b) since you need to basically prove that you've exhausted all other avenues/remedies prior to going to court.

USCIS can tell you status of name check.

Can and Will is not the same unfortunately. But you can take out an InfoPass appointment and pay them a visit in person if you feel like it. Ask them what's holding up your case. See if they care to tell you anything more specific than "it's still pending".

Cool. Congrats.

Thanks! Now I'm just trying not to get any more traffic tickets before the month is out.

Or speak with an IO over the phone who has the same system access.

Done that both. I've been to numerous Infopass appointments and called the USCIS many, many times. 4 times in the last 3 days if that gives you an idea. I think the Pro Se is the way I'm going to go then. I'm sure they'll know as I'm doing it myself it may not be up to 'hotshot lawyer' level, but nevertheless the intent is the same. Power to the people.

Oath was completely uneventful, the guy kept it short and sweet, and we were done by 3 PM.

Now, the post office that's a few blocks away doesn't accept walk ins for passport applications, at least not after 3 PM, you need an appointment. The one that does accept walk ins until 4 PM is at 4700 Longmire Extension in Doraville. You take 285 to exit 32, make a right on Buford Hwy, and then another right onto the second little road on the right, and the post office is down the hill on the left.

They WILL keep your shiny new citizenship certificate, but were kind enough to make a photocopy for me. The original is supposed to come back with the passport in 4 to 6 weeks.

Right across Buford Hwy from there is Buford Highway Farmers Market, and in the middle of it a Russian section where you can pick up a really delicious cake for your citizenship celebration.
