suing emloyer for no pay

I am going to complain to DOL abt my employer not paying me.My checking account has beeen charged off becos no funds(offcourse i was not paid)
now it has affected my credit tooo....

DOL may get my wages back but what about the credit screw up....? can DOL do anything or do i need to sue....?

if DOL made the employer pay can i sue the employer abt credit n stuff...?
 
Your best hope of fixing your credit is the credit counseling agency supported by you local United Way fund.

I hope you did not write checks on a bank account that had no money in it as this can be a criminal charge. If so, you need to find an attorney to assist you.

No i didnot write any checks. my question is my bank accc went negtive becos my comp didnt pay me. Can i sue them for that...?

need info:
Are you working with US employer on H1?
For how many months employer has not paid you the wages.
How much money employer needs to pay you?
Are you working or on Bench.
How did your credit history get screwed up? Employer not paying is not related to Credit history. Explain in details.
** DOL has nothing to do with your Credit history and they can’t correct it.
* If you don’t have enough amount in your bank account to maintain the Bank account then DOL cant help you.

Yea am on H1-B from oct-2008
He has not paid since i started my H1B and not also for 20days i worked at the client.
Now am on bench
I had a few payments set-up in my account thinking i will be paid but i was not.My account went negative and the company still hasnt paid me now my checking account has been charged off and entered in my credit history...

I know DOL cant help me fix my credit.But my account went negative becos i thought i will get my pay every month,my account went negative on november end(i should have gotten paid in oct end if i had my account wouldn't had been negative at all).I thought they will pay me dec but they did not pay.Can i sue them for that...?

-------------------------Bench on H1 is NOT allowed. US Employers need to pay minimum wages according to LCA. If you file complaint with DOL they will recover your payments from US employer.

----Dear employer has not done anything with your bank account . Employer did not set-up your account for payments it was YOU who set up your account for payments. Employer did not login to your account and scheduled payments from your bank account.
If I expect payment from XYZ on date ABCD then XYZ don’t pay on date ABCD date and I set up my account or schedule payment from my account then it is MY fault and not XYZ fault as XYZ has nothing to do with your bank account. You should have scheduled payments from Bank account AFTER the payment from your employer in your account. You can’t do anything for that to employer. If you want to waste some more money then you are free to contact any lawyer and his service will not be free.
