How to start Green Card Process

Hi folks,

I know that's a dumb question but can anyone briefly explain what are the steps to be followed to apply GC, who is on H1 after completing masters in U.S.
G.C is all new to me and it's confusing when I read bits of information here and there and later relating them together.I'll do my homework once I get the basics understood well.

I really appreciate your help.

If you apply through employment,

1st step: File Labor certificate. Search PERM on google.
2nd step: File I-140
3rd step : File I-485

When does this EAD phase occur? can you have some peace once you get that? I mean, u can work for any employer you want to right?

Isn't the basis of Employment Based GC, in part, that you are such a loyal, valuable employee, that your company will sponsor you for a work visa, eventually a GC, and you will continue being "their" loval and valuable employee for years to come... at least in theory? :confused:

That is correct. EB applicants must be loyal dog of employer :D

but anyway answering OP's question, EAD can be filed with I-485.

Yes, and in practice "years" can be cut short to 90 days or so. :D Or, one can even use AC 21 at some point to go work for another employer and still continue the process. Of course, if the company were to pay for the GC and lawyer, I would find it disingenous on a personal level to start the GC process with a company just so you can leave them ASAP.
 
Same thing with marriage based GC... the theory is that you "love and build your marriage for years to come, not to get divorced after you get your GC" :p
 
If I may threadjack for a second, austriacus, is your timeline indicating that you received your green card within six months of filing? Is that fast? Or normal?
 
That's right Scully70, and it used to be normal at least, not sure what's going on now with all the receipting delays etc. If Praetorian hadn't deleted his timeline you'd see he got his a lot faster than I did, just over 3 months I think?

But with name checks pending etc. it can drag out to years, so you never know.

My timeline is too much trouble... but all you have to do is ask :)

Thanks. Yeah, you never know, but it's nice to know that it might be possible to visit our newborn niece in the UK next year instead of the two years I've seen.
 
Scully70, I don't know the details of your case (hopefully a pretty standard AOS case?) but there should definitely be a hope and a good chance that your case is approved around a half year after you file (although, never count on it).

I'm sure these forums suffer from "survivorship bias" to some extent, i.e. those whose cases go through quickly drop off the forums and live their happy LPR life, and those who have problems where it takes longer, stick around and keep reporting on their multi-year adventure. I'd say out of us May filers, around 80% were approved on the spot, and we now have most all of the yet-to-be-approved friends trickling in month after month reporting that their name check has cleared.
 
Thanks, the details of my case are in the thread I started earlier today about which forms to file. Unfortunately, we've been under the delusion that we had to file the I-130 first and then the I-485 and have had some big mail delays, but hopefully after the holidays we'll be able to file and *crosses fingers* have no more hiccups. My husband was just worried that it might be two more years before he gets to visit his family again, but that seems to be an outside time to get the GC, in worst case circumstances.

This forum's been very helpful; I only wish I had seen it months ago! Thanks again.

What would be the BEST TIME to start GC process while on H1? (like 1 yr before H1 expires or sth like that???)

and also, does taking perdiem effect my GC process? If so, what's the max perdiem that one can take??
 
Start the process as soon as your employer agrees unless you have reasons to delay it.
And what do you mean by max per diem.

I'm taking 12$ perdiem which I'm not filing in my taxes. In first place, does taking perdiem for long period effect my GC process? If so, is there any max amount (XXX dollars) per month/year that one can take?
