Here is my case:

I came to the USA in December 2001 with F-1 Visa. I graduated on August 2006 and I am now working in the USA based on my OPT(Optional Practical Training from school). My OPT will expire on August 31, 2007.

However, on December 8 2005, I filed my I-130 and got the receipt on December 11, 2005 with a status "Pending", since my wife has a green card.

Two week ago, my wife became a US citizen, and I am not sure what should I do in this situation to finish up my files.

All what I care about now is my work permit becuase I don't want to lose my job on August 31st.

Any ideas ????
please !!!!

Your wife should send a letter to the Service Center with Jurisdiction over case asking them to upgrade your case from an immediate relative of an LPR to an immediate relative of a U.S. Citizen. The letter should include your name as the beneficiary, your wife's name as the petitioner and your case number. Also, attach a copy of the receipt of the I-130 you filed in 2005 and your wife natz certificate.

Once you case has been upgraded, it should move a lot faster. You should also file for employment authorization

If she became an US Citizen, your priority date becomes current. You need to upgrade your petition and go ahead and file for adjustment of status (I-485).

Thanks for your quick response.
We called the immigration center on May 24, 2007 and asked them to upgrade the status of my file.
They gave me a confirmation number for updating the status, and they told me that within 45 days, I will receive a letter conifrming that.
So, my question now, what files should I send, and can I get my EAD before August 31st, 2007?
Please give me details, because I asked a lawyer, and he said he will charge me 1800$ to take care of my case.
Thank you very much.

Use your I-130 receipt and file for AOS using I-485. You can also file for I-765 for your EAD and I-131 for your AP, if you intend to travel.

Send a copy of the I-130 receipt with your AOS package.

also enclose a copy of her naturalization certificate and a cover letter explaining your situation (upgrading a petition).

Thanks for spelling out clearly my "intended" post above. We all know NEVER to send originals to USCIS. Was having a blonde/friday moment :)

Okay now,
So all what I have to do is to fill out the

I-485
I-765
I-864
G-325A - Biographic Information - U.S. Citizen
G-325A - Biographic Information - Foreign National Spouse
693 - Medical Examination of Aliens Seeking Adjustment of Status

and what else should I do, and who should I send it to since my I-130 was in California Service Center?

thanks

Triple citizen,

Thank for informing me about that. But would you please give me some details about what should I file exactly, and how much should I pay for it, and such stuff becuase this is the first time I and (hope it will be the last), but I have no clue about anything except for what's written in this form.

Thanks

You have the forms listed correctly. Search the forums and read up other posts. There are tons of similar posts. Then download the forms from the USCIS website and read the instructions for each one of them. That will let you know the cost and what accompanying documents are needed for each one of them.
Remember, this forum is for getting pointers, not for spoon feeding :)

yes, send a copy. When the application asks you to send a copy of something, that is your authorization to make one.
