Quickest way to petition sister

Hi,

I am US citizen and wish to petition both my mom and sister.

My mom I believe is fast but my sister could take a lot longer.

My sister is 34 years old, unmarried and has 2 kids (8 and 12).. She does live with the father of both kids but they are unmarried.

Both my mom and sister are mexican citizens and live in Mexico..

THis is what I think based on what I am reading but am not sure.

One way to bring my sister is for me to petition her now but she falls into the 4th family category and they are currently processing Mexico 4th category for priority date 7/1/1994.. This will take 13 years to be current.

Another way is to petition my mom.. From what I understand that is quick.. Wait 5 years for her to become a US citizen and then my mom applies for my sister... Not sure what category she falls into and how long she will have to wait if this path is taken.. Anybody know ?

Anybody here in this forum have any other ideas on how my sisters petition be quicker ?

Need to be sure before any action is taken

Looking at the current visa bulletin, its still going to take a LONG time for your sister, regardless of whether your mother sponsors her or you do.

The fastest way for your sister would be if your mom files a petition for her (family 2A category) once she gets her green card. The current processing date is 01JAN01. Only, her husband wouldn't be able to immigrate with her. I believe, the kids would be beneficiaries of her case.
 
Shouldn't the OP's sister (single, not married) fall into F2B if sponsored by her mother?

of course, she does. And she can't get married either (well, not until AFTER mom gets her citizenship).

That's right. Sorry, my mistake. :o
So, it's Family 2B not 2A, and the current date for Mexico is 01MAR92, which is even worse than the current date for 4th category: 01JUL94.

Yes from what I read and I understand she falls into Family 2B and that is a loooong time. So no matter if I apply for her or my mom she will have to wait.

It appears that maybe the best way is for me to apply for her and she will just have to wait 12 years ..... Unless somebody has a better idea.

Another question came to mind.

If I do apply for her and she waits 12 years, that will make her daughter 24 and her son 20.. What will that do to her future petition for them ?

I assume that she would have to become a US citizen herself in order for my sister to petition them and that is an extra 5 years ....... Her daughter will be 29 and son 25.... What if they are married by then and have kids ? Sorry but so many different scenarios open up as time goes by

they need to included (I do believe that you can file a separate application for each one of them). Of course, the oldest will age out, but if the petition is pending for a long time - 4 years or more, then the Child protection status act may kick in to benefit the kid. The youngest may or may not age out.
 
Why not petition for her now, if you are following whats going on in Congress maybe you will not be able to do so. Some Republicans are proposing to cut family based, but the Democrats dont want to allow that so the battle continues. If the Republicans have their way you will not be able to petition for your mother muchless your sister. So petition for them now because who can tell they might just come up with some timelines.

That is exactly what I told them yesterday .....

I will just apply for both of them now regardless of how long it is .... Thanks everyone for your input
