RFE by USCIS & Withdrawing the Petition - Gurus Respond

Hi,

My lawyer botched up my concurrent filing in EB2 and UCSIS issued an RFE that we cannot respond to without weakening the case and possibly getting a denial. I would like to withdraw the case and refile with a new lawyer if possible. My question is; will INS refund the filing fees?

Any ideas Gurus? Any links would be appreciated.

What exactly is requested in the RFE and why will your response weaken your case?
