With a pray to Almighty God, I am starting this new thread. Please post update and related discussion here. I hope very soon it will find a signature of the President.

Competeamerica has given indication that EB provisions are included in the new House bill. Thanks to Competeamerica for pushing EB GC issue along with h1B.
Some people have raised the issue in past that competeamerica will only push h1B.

EB-based part of STRIVE

Following is the summary of the EB-based part of STRIVE: (from immigration-law.com)

03/22/2007: House Version CIR "STRIVE ACT" and EB-Based Immigration Reform

This bill is scheduled to be introduced in the House shortly. Pending the introduction, some organizations were successful in obtaining advance copy of the bill and released the summaries.

As for the Employment-Based Immigration Reform, it appears that the key provisions include:
>>Total EB Annual Quota: 290,000

>>Recapture of Unused Number for the future years

>>Groups Exempt from the Numerical Limitation:
EB Spouses and Children whose visas are issued after 10/01/2004 upto the annual maximum of 800,000.
Certain Professionals including Extraordinary Ability in the Sciences, Arts, Business, and Other Critical Fields
Foreign Students with an Advanced Degree in STEM from a U.S. Institutions or Foreign Institutions

Are you writing anything different from KodalMD's initial message or are you just too excited....:)

50-50

According to my lawyer, the chances of STRIVE becoming a law are at best 50-50, if not worse. The only good thing about EB relief not occurring is that there will be no increase in H1B either, and so by 2009 retrogression will be considerably reduced. It is possible that in 2009 with a new president, there is a renewed push for another immigration bill, but who knows?

Not trying to sound an alarm bell here, just a cautionary note. I doubt that we can do much other than finding alternative measures to improve our lives.

The chance of STRIVE becoming law in its current version is zero. To survive a vote in both the House and Senate it has to be less generous for legal and illegal immigrants.

I cannot see how the House (and to a lesser extent the Senate) will approve any increase in H1-B visas, that itself looks like a death knell for any positive traction this Bill will receive.
Strike it out and it looks more viable to pass.

I think H1-B quota be removed from STRIVE ACT as people are coming in L1 more than H1 now a days.
It may depend on how quota goes this year. If it got exhausted very quick as being expected , they may increase the H1 quota.
Many L1 may be due to shortage of H1 quota. If I remember correctly, DOS issued statement a few years ago, and they said they could see abusive use of L1 to fill in H1 position after H1 quota was exhausted.

It is up to them to stop the abusive use. It is ridiculous that a company will file for hundreds of L1s in a year and get them approved, when it is so obvious to you and me that the majority of the employees for whom they are seeking L1 are just regular low- to mid-level staff.

The more time passes without any juris on the Bill the more its fading.
Come May if there is no debate on STRIVE, the bill is dead in this sitting of Congress, and even then it only has a 50 % chance of passing.
The 111 Congress will be more inclined to debate ending Iraq, ending WoT and the next presidency than immigration.
The next chance at resurrecting immigration is 2009.

Update 1 More on the H1-B increase fallout

This is mainly related to temporary foreign workers (H1) and less related to GC process.
