There does not seem to be a consistent process being followed at the Service Center. Some agents do provide the information with regards to the name check clearance and some do not. It depends on the representative responding to your call and his/her attitude towards customer service.

I would suggest you to keep trying. Also, you are eligible to create a service request if your I485 RD is more than 1 month older than the 'current processing date'. You have to dial the same sequence of numbers as the POJ method - but dial 3 at the end instead of 4. If they ask you the reason for calling, tell them upfront that your case is pending and is 1 month older than the processing time and you want to create a Service Request. They must create a Service Request, irrespective of whether your name check is cleared or not - provided your case RD is one month older than the processing date.

I asked him about name check, to which he answered that I should check back in 12-15 months since the local office does not have my paper file. Whats the points of Infopass if they don't have your information. TSC had told me earlier that NC is clear.

I asked him about cross charge, to which he answered that I should send a certified request to Texas (that was the only useful thing he said). He seemed confused by CC.

Finally he told me: "Don't worry you will get an interview notice from TSC, then you can come back here". He also pointed to the interview room.

Again, as I said, the process is not consistent. The officers at Infopass do have the information and they could check if your name check is cleared or not. A lot depends on the attitude of the representative, training level, etc. I have gone for Infopass appointments and checked for name check clearance in the past. I came to know about my wife's name check clearance through an infopass appointment.

I am going for an infopass appointment this week to confirm on my name check clearance and also to ensure that they are considering my case as a cross-chargeability case. I will keep you all posted.

Hi All,

Called up TSC yesterday using the POJ technique and updated the address on my and my wife's 485. The IO said that my case is "pending" after confirming again that my NC is clear and not yet assigned to an officer.

Saw an LUD today on both our cases as a result of the addr. update.

Interestingly there was no LUD last year when I did an address change.

I had also started an enquiry last week, may be that triggered the LUD, but way back in April'07 the enquiry resulted in an LUD only on mine and not on my wife's 485. Then again the standards might have changed.

Spoke to Ks_CC a few days back, said hi to everybody.

I did the same. Called up the service center using POJ and opened a SR. I found out today that my spouses name check was clear, so the only thing thats pending is my background check.
I saw the EB2 dates for India retrogress back to 2000. Those dates have to be taken with a grain of salt of USCIS is to be beleived. A mere 6 months ago, everyone and their mother was current. I am pretty sure those dates will move forward (most of the peeps on CC should not be affected though)

It is tricky since everyone at the service center does not know about the cross-chargeability clause. So, you or your lawyer have to be very particular about how you request the service center to consider your case as cross-chargeability. Also, I would suggest that you put a cover sheet on your package that you send to service center, that screams in bold letters "ATTENTION: SUPERVISOR; CROSS-CHARGEABILITY CASE; REQUEST TO APPLY SPOUSE'S BIRTH COUNTRY FOR THE VISA NUMBER AVAILABILITY"

My I-485 application has been stuck in FBI name check for nearly a year now. I have tried contacting the senator's and congressman's office to expedite the process, but it has not yielded any result. Now I guess I have the First Lady's office & the FOIPA request to pursue. I tried searching for FOIPA form on google, but I got an FOIA request form on the FBI's webpage. Is that the correct form? Could someone please post the link to the form?
Any help is greatly appreciated.

That is the form, go ahead, good luck.

Dont expect anything from the FL's office before 3 months after u send in the letter. Remember to attach a copy of ur 485 apps(4 both) zerox.

Both my wife and I received our GC's last friday.
I had cleared namecheck on Oct 18th and it took 2 months to get the final approval.
I had to approach the senator's office and had to write to the USCIS ombudsman's office to get cross-chargeability applied on our case. I also had our lawyer send a letter to NSC.

For namecheck clearance I had to write a number of letters. I wrote to everyone from the senator, to FBI chief, Attorney General, President, Vice-President, First Lady, ombudsman and secretary homeland security. I think First Lady, Vice President and President's office helped me in clearing Name Check. In response to one of those namecheck letters, I got a reply from USCIS customer service specialist saying that there were no visas for India and that is why the application couldn't be approved.

After I cleared namecheck, I used that letter to push my senator's office to do something about my case as our case should have been treated under cross-chargeability. I believe the senator's office did push NSC and got the ball rolling.

My NC got cleared on 11/7 so I should get the approval email on 2nd Jan '08. Well nobody knows except God, just trying to remain optimistic.

I once got redirected to the National Service Center because at TSC no one was available, I guess it was lunch time and the IO there told me that I had initiated an enq about a week ago, so I got to wait.

But @ TSC/NSC they dont keep a tab.

Its never too early to keep a tab on your green card process. Feel free to call TSC using POJ and you could get info on your Name Check. Also, if you do find out that you are stuck in the name check, you can start writing letters early on itself. Its always good to be proactive on your case. Atleast thats what I feel!

But she told me that these cases will be assigned to an officer or processed when priority date is current for my case. I tried to explain that my priority date is current based on cross chargeability. But according to her these cases will be processed according to the primary applicant.

I have already requested my lawyer to initiate a request to apply cross chargeability for my case.

What should I do next?

Its frustrating as the IOs dont seem to know about CC. We have sent letters, fax etc. Keep checking and ask your lawyer to be persistent.
