Labor Processing Times in California Due to 245(i) Part 5

My lawyer received a transmittal notice from EDD

My lawyer received a transmittal notice from EDD stating "they have sent my application to US Department of Labor on 02/11/2002".
 
Case Transfer to DOL - At Last!!!!!!!!!!

I just got a call from my lawyer that they just got the receipt that my case was transfer to DOL. My lawyer says it will be at least 1 more month of wait. Here is my info:

PD: June 22 2001
Tranfer Date to DOL: February 15

So, ufffffffffff!!!!!!!! I feel a little bit relief....

What the hell is happening in SESA.

there is no consistency in case # s and PDs
 
Hey ALL Tracking list is stopped at Puppy143 PD 22OCT

Hey All,

The tracking list was stopped at PD 22OCT 2001.
If you feel the list is too big we can delete all who got TRF to DOL from the Tracking list.
Please actively update with your data it will help every one to track the process of SESA.
 
To add to the confusion...

Look at asic chip:
PD 6/5/01
Case# 95xxx
Xfer Date: 2/11/02 !!
According to SESA they completed PD 6/5/01 around Jan 5th, yet the xfer date for asic chip is 2/11. On the other hand, Adriana\'s case has PD 6/22 and xfer date 2/15.
And, my PD is 6/15 and my case is still not xferred.
SO: SESA is just working the cases randomly. When they say they are at 6/25/01 they probably mean they have "looked at at least one case with a PD 6/25/01", not that they have "completed processing for all cases with PD prior to 6/25/01".
 
True ....

I remember how INS used to do it, when transferring my H1. I went nuts, \'cause my case was approved *1 month* after they announced processing of my PD.
 
to add to confusion

I did speak to my attorney on this subject. Statement "According to SESA, they completed PD 6/5/01 around Jan 5th" is misleading. Its actually that SESA started reviewing cases filed on 6/5/01 on Jan 5th. According to my lawyer, an officer can take upto 4 weeks after the start review date to make a decision on the case with the given PD.

In my case, my attorney said that if they didnt hear from SESA within 45 days after Jan 5th, they will send them an inquiry.

SOME MORE CONFUSION ....

A lot of the lucky guys got their RD in just about 2 weeks. It took mine about 2 months.
PD - 11th May
Transfer to DOl - 13th Nov
RD - 7Jan.

Anyone in the same situation?.

Congrats!!!.
As we can see that Laxman\'s case took about 4 months to get approval.
That should give us a fair amount of time frame for our processing time. Atleast 4 months....Keep praying.

All Your valuble inputs needed

Case is:
I have H1 with the present company and the validity is till July 2003.

If I move to another company, they will file H1 transfer.
After H1 transfer approval, say I will join that new company.
After 6 months or 9 months .. I am not going to send my passport for stamping with new H1 transfer approval papers. I Just will hold Transfer approval papers with me.
Can I join back in my old company with same old H1 (because its already stamped)?

roommate had exactly the same situation and according to his lawyer, "The moment your transfer application is approved your old H1 becomes null and void."

You can do that. One of my friend has done it before. New H1B will NOT automatically cancel the old H1B. You can have any number of H1B visas at a time. INS will cancel the H1B visa, only on the request of the sponsoring employer.

My question is not to have a New H1. I am sure you can have multiple H1s
But Have the old one transfer.

In that case. While working in the old company, if new company apply for transfer of H1, and got it approved.
Due to some reason If I am not joining the new company, and still continued with old company, then what??
Can any one give some input on this
