working on H1B... can I use AP?

Dear all,

I am working on my H1b, but my visa stamping on my passport will expire in march. I would like to go my home country and it takes a while to get h1b stamped on my passport becase of waiting times. I already have ead and AP but i have,nt used them. So when I go to my home country can i return to US with out my H1b extension but travel on AP??? Your suggestions would be great help for us.

if you use AP you loose H-1 B status and have to work on EAD and renew EAD and AP every year. I would recommend keeping your H-1 B status but its your choice.

Wrong. The Cronin Memorandum allows one to re-enter using AP but continue working under the terms of a valid H-1 petition.

still hanging in there? Guess we're all still stuck in name check! By the way, how long did it take for you AP to be approved?

I am happy with canadian's answer that I can use my AP and still work on H1B... It took me about 10 weeks to get AP
