Working ON EAD

Hi Guys,

I am working with my H1 with my parent GC company...is it ok!!!?? if i work on EAd apart time job!!??


MY lowyer told me that ...if you are working on ur h1 with parent gc company and if u work part time EAD...is not having any problems..

Guys any experiance.....!!!

---- your lawyer is wrong he did not tell you that you will NOT be on H1 status. if your I-140 is approved AND I-485 is pending more than 180 days you are safe to use EAD and once EAD is used you will need AP approved in Hand before you go out of USA to use AP for rentry

Interesting .... After seeing that I re-read the Cronin Memo. I quote from there
However, an H-1 or L-1 nonimmigrant will violate his/her nonimmigrant status if s/he uses the EAD to leave the employer listed on the approved I-129 petition and engage in employment for a separate employer.
Seems like H1 would be invalid only if you leave your current job & use EAD to join some other employer -- from just this memo, it seems like EAD for part-time won't necessarily affect present H1 as long as all of the H1 conditions are satisfied...
 
Ya..also read in Murhty.com..its saying that we can work on EAD but you should run Payroll with the Parent GC company also....

Guys...is that make sense...!!??any comments!!!?? :confused:
 
I think, what Murthy was saying that if spouse uses EAD, then H1 remains valid and h4 is void.

Question 10. Does the EAD void the H1B? TOP

An H1B nonimmigrant has the option of applying for an EAD. However, if the person then uses the EAD to work for the same and/or another employer, s/he will no longer be maintaining H1B status. Just having, but not using, an EAD does not invalidate the H1B.
