I sent my petition for a withdrawal sometime around the 2nd week of December 07. The circumstances for the withdrawal can be found in this thread ( http://www.immigrationportal.com/showthread.php?t=278616 ). I requested an Infopass 3 months later and was told by a clerk at the DO that it that the petition was processed on the 4th week of December 07.

Now, my question is: I have not received any notice or anything in writing, does USCIS mail you a withdrawal confirmation to your address or should I be concerned that it hasn't been sent yet?

Any comments will be really appreciated.

Thank you.

They should have sent you a confirmation letter by now that your case was either abandoned or that that you withdrew it. Speak to to an IO either via Infopass or phone and tell them you haven't received any notice yet.

FJMB23, I have stayed outside the US for about 18 months out of last 5 years (never more then 6 months) and recently completed my citizenship interview. Most of the stuff during the interview was similar to your interview but the officer focused more on two traffics that i receivd as well as my birth certificate. She just mentioned that I have spent long periods of time outside and i explained why (mostly family reason) and she seem to be satisfied. I passed the civic test and she gave me form N14 - missing documents and asked me to send copies of my birth certs and receipt of traffic tickets within 30 days which i did.

Still awaiting the final outcome.

I had asked the continuous residence question to Rajive Khanna also and his take was if you have spent 2.5 years out of 5 years in the US then it should be ok. Obviously that was not ok for you. I produced copies of my tax returns as evidene of workng in the US.
not sure why that would not work for you.

I guess end of the day its really subjective as every office seem to have some leeway in how they interpret the rules.

keeping my fingers crossed.
