With H-1b tranfer and wife's H-1B

Hi,

I would really appreciate if someone can answer this.

I have an H-1B from company A and my wife was on H-4 with me in US. Recently we applied for an H-1B for her. But I got an offer from company B and would be transfering my H-1 and my wife's H-4 with that company. How will that affect her application for H-1B?

did you file your wife H4 to H1 change of status?
did she got H4 to H1 approved?

I do not know whether it is H4 to H-1 transfer case or it is a fresh H-1 case. She never had H-1 before.

No her application for H-1 is still pending.

---------- try to find out from her employer or lawyer who filed her H1 they know if it was filed H4 to H1 Change of status.if she does not want to be on H1 then you can file her H4 extension with your H1. better talk to her lawyer or employer who filed her H1
