Will it cause any Stamping problems?

Hello:

My visa has expired 05/2000 (I last entered US 02/2000); but my I94 is valid till 03/2004.. So I am still in legal status right (legal presence in US)?

1) My ex-employer laid me off; but did NOT cancel my H1B; so my I94 is still valid right? If they DID cancel my H1; then is the I94 still valid? My lawyer said it is...

2) Will this cause any problems while NEW stamping in Chennai? As I don't have tax papers for 2001/2002?

ANY help is greatly appreciated... As this is very stressful for me.

------ you should check or read what is happening in Chennai Tax papers are very important

*** your stay may be legal with I-94 but you may be out of status if not worked on H1 and were not paid by employer, it can create problems for visa stamping and they can ask any documents

I am SERIOUSLY considering Mexico as Option.. Do u thnk it advisable? I will go thru victorgarcia.com. Is Chennai that BAD these days?

I feel like I am in a big soup becuz of this.

If you go to Mexico or Canada and H1 stamp is rejected then be ready to go directly to India from Mexico or Canada you will not be allowed back to US, then get H1 stamp from Chennai and enter with H1 visa
