Will H4 be issued even if H1 is valid for less than 3 months?

Hi,

I will be travelling to India for marriage in Aug, 2002. My H1 visa expires in Oct, 2002. After my marriage, when I apply for a H4 visa for my wife, I will have only 2 months of validity on my H1 visa. Will this affect the issuance of H4 visa? Is there any rule that stipulates the minimum validity of H1 visa, after which, H4 cannot be issued.

Ofcourse, when I come back, I will apply for visa extension through my employer.

You are better off by applying for extension now before going to your home country and provide that info to the US consulate while applying for H4 for your spouse.
Depending on the country where you are applying for H4, and the qualifications of your spouse, H4 application has a possibility of rejection and you do not want the expiry in another 3 months to be a contributing factor.. My 2c
