Wife on H4 want Divorce...what to do

Hello
My wife is asking for divorce. I am on H1 and she on H4...where should I file the divorse paper...In the past I gave some psychological treatment….she gets violent ….Her parents & siblings are aware of this and her father said that she should not come back home and he will not allow to enter in her home…..I don’t want to send her to relatives (her’s) leaving in US….how can I get rid of this issue…. Please help its urgent
 
See a family law attorney; it is essential to preserve your rights and share of property. Her H4 is dependent on you; she will need to leave the US once it is final if she does not qualify for another visa status on her own.

I suggest that since there has been violence, you leave your shared home and either stay with friends/relatives or a new place. You will have to support her - not neccessily as much as you do now - until the divorce is final; the support requirements after a US divorce depend on many things which a family law attorney will advise you about since these are very much dependent on the state in which you have residence.
 
If my wife goes back to India can I file the divorce with out her presence in CA or any where in US??
