Hi i am from india..i got married to a us citizen last year..my husband flew back to usa after 6 months of our marriage .because his business was gettng affected in his absence. Now my query is that. I did not have my passport ready when we got married so i did not accompanied him to us..secondly his parents are very old and not in a physical state to travel and since he is the only son there is nobody to take care of them..so i decided to stay back. Now i have got my passport made in mumbai about 2 months back..the problem is he cannot come down to mumbai even for a week because of his business. He is sending me his passport xerox copy.. Plus we have our marriage certificate ready here in mumbai. He has asked me to apply for b1/b2 visa.. And come down to usa for a month or so.. To stay with him and then i will have to go back to take care of his parents.. Will i be able to get a visitor visa.. As i am married to a us citizen.. Or is it necessary for me to directly apply for a green card or immigrant visa ?? Cause i am not in a hurry to get a green card as i will have to keep traveling back and forth from usa to mumbai.. Please help.. As i am planning to go for my visa in the next 2 weeks time..

Marriage to a USC will affect your B1/B2 application, every B1/B2 applicant is considered a intended immigrant anyways unless proven otherwise at the interview and you are wife of a USC that makes you even more of a intended immigrant, but nevertheless its worth a shot, tell the consular officer very clearly that your intent is for a visit only and you don't intend to get a immigrant visa because you are the primary care giver to your Husband's aging parents and cannot go back and forth to US every so often to maintain the immigrant status. It will be very beneficial if you tell the consular officer that whenever you are ready to settle down with your husband you will apply for Consular processing in India for a Immigrant visa rather than adjusting status while in US and WILL NOT cut in the line of spouses waiting to get thier immigrant visa in India.
The law just don't allow it when people enter US with a visitor visa when the intent is to get a Permanent residency and understandably so because there are people waiting in line for thier turn to join thier family in thier home countries.

Thanks you all for your answeres..another small query was that to immigrate pemanently..will he have to file for a k3 visa or i 130. For me ??..and since i am his wife how long will i have to wait in india to get the immigrant visa..approx how many months waiting period is their for spouse..

He starts by submitting an I-130. Total time from start to finish should be under 12 months.
