Wife entered legally married to us citizen visa appointmen to cd juarez why?

Hello all !:D
i am new to the forum and would like some help or advise in my case
well here it goes.

my wife entered legally to the US via B-2 Visa in December 1999
she overstayed and run out of status in 2001
we got married in 2003 ( i was just a permanent resident back then )
i became a us citizen in 2007
i started all the process for adjustment of status in 2009
(took a while cause of economical hardships)
i send all the paperwork fees original documents etc to the visa center.

now today my wife called the visa center and they told her she has an appointment
in Ciudad Juarez December the 3rd!

what went wrong ?
did i missed something ?
i did give all the info i had

any advise would be really appreciated.

What do you mean when you say "I send all the paperwork fees original documents etc to the visa center" ???????
Visa center where? What address?
 
If you send all papers to NVC after they contacted you then you probably didn't file I-485 with I-130 concurrently. Let NVC know she is in US and follow their instructions.

like i said before she came here legally and ran out of status
as far as i know she can adjust her status without leaving the US
i did give the i-94 and border crosser visa number in the 1-30 application
 
You should not have filed anything with the National Visa Center. The NVC deals with people who will interview outside the US at the consulate. I hope you are aware that if she leaves the US before green card approval she will be unable to return for 10 years.

You need to forget about the NVC and have her file an I-485 with USCIS (along with associated paperwork such as I-693 medical, I-765, I-864, G-325A, but NOT I-131 which would be useless because of her overstay).

Call the NVC ( 1-603-334-0700 ) and tell them that your wife will be adjusting status in US. If they have already sent your file to Juarez, I believe they will have to send it back to US. Do not and I repeat DO NOT let your wife leave US as she will get a 10 year ban.

thank you all for your quick response

i did call the NVC on Friday and they told me that they cant do anything about it and that i should call USCIS

also i did fill I-30 and I-485 together

i did all myself just to save the Lawyer $$
maybe i should had pay for professional help
it looks like i did something wrong or i did not filled all the forms that
where needed

Do you all think it would be any trouble to get the paperwork
from Juarez back to the USA?

Her interview in just one month away
 
i think that maybe USCIS messed up since i did send I-130 and I-485
And i did say that she entered Here legally and that she was living here with me.

also in line 22 of I-130 i did say she would be adjusting here

well i will talk to USCIS on Monday wish me luck! :D
and don't worry my wife is not going nowhere she has 2 kids;)

Well, the thing is you sent the application to the wrong office. Do not worry about her interview in December, she will get a new interview date after the proper procedure i-e fingerprinting and such once you file a new application with the appropriate USCIS office. I don't think you messed up by not using a lawyer, you could've found all the info online, and its not too late you can use this forum to ask questions if you have any and read other threads that will walk you through the entire process. Good luck :)

Well i did initially send the i-130 and I-485 together to USCIS
and later i did get the approval letter from USCIS
after that i stated getting letters from NVC
i just followed along thinking in my mind that it was a normal procedure
for the adjustment of status.

Boy i was wrong!

Now i have to try and fix this mess
o well i just hope i am not the first one who has gone trough this kind of situation.

Which USCIS address? Somewhere other than the NVC address you quoted above?

Did you get an I-485 receipt notice?

i send both I-130 and I-485 Including the fees at the same address USCIS had in their website
i did get a receipt and approval for I-130 but not from I-485
 
For the I-485, use the USCIS address listed in the latest I-485 instructions.

Did she go for the I-693 medical? If not, or if it was done over 12 months ago, it needs to be (re)done to send with the I-485.
