While waiting for a decision, i want to go back to my country for 2-3 weeks

i wanted to see what you guys have to say about leaving the us for 2-3 weeks while waiting for a decision about my case.

i don't have an easy case - i left the country for 10.5 month, came back and then left again for 179 days... i have total days out side (whine the last 5 years) of bit less then 700 days.

i submitted all the doc's to show my ties here while being a way... and now I'm waiting for them to send me an answer (hopefully a good one)

I'm thinking of going back to my country for 2-3 weeks. my attorney said - NO! not even for 1 day, not to leave - coz they can use the trip to say that i have been out of the country too much.

is that true?

did any of you left the country before the oath ?? did any of you get denial for that reason?

I'd love to hear from other people experience or knowledge about this.

In terms of the physical presence requirement, any travel after the date of filing N-400 is not relevant - the physical presence requirement only has to be satisfied at the moment of filing N-400.

The continuous residency requirement has to be satisfied all the way to the naturalization oath day. Ordinarily, a relatively short trip abroad (such as 2-3 weeks) after the interview would not be a problem (except that you may miss the oath letter and, if you are really unlucky, the oath ceremony itself). However, if the applicant does have a pattern of frequent absences and if the continuous residency issue is already a problem (as apparently is the case with you), it would be prudent to avoid any foreign travel after the interview and before the oath.

But if your last long trip ended right before you filed the N-400, more trips during the process could make it appear like an extension of the preceding long trips, making your approval more difficult.
 
My case is so similar, what can we do if they deny? and we file the 336 and they deny again, how long do we have to wait until we are able to apply again please

well the 2 big trip ended: the 330 days - i came back on September 08 , the 179 days - i came back March 09.
i did have other trips in between... and my very last one was during the process (after doing the finger prints) and before the interview for 12 days (also for the holiday at that time).

my frustration is with the fact that it should be all about the days out side the us no?! so even if i go now for 3 weeks I'm trill "good" with the total days.

if i wanted to go back live in my country - wouldn't i just stay there?!
i live here, im married here, i have business here , i have my life here ... i just go back to my country to be with my family during important days as holidays...

so what do you think i should do?
 
If you can wait, it would be wise just to keep CIS happy (if you're approved, or intend to appeal if you're denied). A family emergency is different. If it's just to go to the beach, best you postpone the trip.

It's not just about counting the number of days. Continuous residence is about your overall picture of travel and ties to the US and whether those facts indicate that the US was your primary residence for the last 5 years and still is your primary residence.

so what do you think i should do?

Given how long ago your big trips were, a 2-3 week trip or even a 2 month trip now isn't going to come close to breaking continuous residence.

no update :( nothing that look like a respond (I'm not even talking about the on line status that is still on "interview").
its been 1 month since the officer got the documents he requested and in 4 days it will be 2 month since the interview.

i just hate the "un known" and its killing me that i was told not to leave (not even for a day). so I'm just waiting without knowing how long it will take.

my attorney now say that we have to wait the 2 more month before start requesting meetings with the officer/manager or what ever is the next step.

any word of encouragements with be gladly appreciate here :) i need those now...

Don't lose hope! When the sun goes down, the stars come out.

+ USCIS usually respond within 45 days. You are still in safe. Be patient. :p
 
Sorry to hear that Neway, I'm in the same situation, everyday I wake up, get my coffee and run to computer to check my status... so stressfull..., let's keeping praying and hoping for the best...Good luck and keep in touch

hi julie_9 , how long have you been waiting for?! what is your case all about (i saw you wrote its similar but what is the situation with your case?)
 
It's been a month since my interview, (5 months total), the IO requested more documents (old leasings) which I already sent it, so now is just wait..., have you heard anything from them yet?
 
Just a word of advice to Neway. An oath letter can come very shortly before the scheduled oath date. My father's case hanged for 6 months for no apparent reason (he was recommended for approval), and then he received an oath letter 2 days (!) before the oath itself. He is usually a relaxed person who checks his mailbox once a week, but luckily for him he was checking mail at least every other day while waiting for the letter. I know this is a very weird and unusual experience, but you would not want to miss your oath because you could not wait to go back to Israel.

you have a point :) if only i would know for sure that i will be approved and the oath is on it way....

NO!!! no update , no mail - so frustrating!!!

Its already 2 month and 9 days from the interview / 1 1/2 month since they got the package with all the documents...

and no respond so far... I'm also getting nervous as i would really want to be over with this process so i can go visit my family for the holiday :( i still hope that can happened...

what about you Julie_9 ?

I was just about to get the infopass when I got the email last week, what made me even more anxious...some people told me that they don't take that long when they are doing this phase (about 10 days) but again, depends of the officer..., hope that you have news soon, let's keep the hopes up, right...keep in touch...

no i didn't call and I'm thinking they probably wont know anything... beside that, when i asked my attorney she said we cant really do anything before the 90 days so hopefully i wont need to wait that long. cross my fingers (for you as well). at list you go some respond from them - it is something,... keep me posted ...
