Which status H1 or Payrolee?

Hi Every one,

Had couple of question on my H1B extension. My H1B expires in December of 2006, I already took an extension for 3 yrs. Now I got my I140 approved in May of 2005 and got our work authorizatios and travel Documents. I traveled to India with my Travel permit and entered as an payrolee. As my H1B expires, do I need to get an extension again or just wait for my GC. My priority date is Sep 24 2001. My husband and kids also are under Payrolee status, if we extend H4 then are they going to loose their work permit's and stop working... it's too confusing. please help... :confused: :confused:

If they want to stop working, it's good to change to H4. Otherwise, there is no point to change back to H4 as they have to come back to AOS pending right next day of H4 approval if they use EAD to work.

So you say their is no reason to apply for H4 extension and keep renewing work permits every year for my husband.
How about me, Do you think I should apply for my H1 extension? If not I thought I'll fall in to an illegal status, am I right.. correct me.
(My prority date is Sep 24 2002). :(

Your spouse does not need to extend H4 if he will keep working with EAD(assuming he has filed I-485 already). That is just waste of money.

You won't be out of status even though you did not file H1 extension provided you have already filed I-485, but you yourself had better to extend H1 just in case.
 
I think that by entering on Advance Parole you have already parted from your H1B which means you cannot get any more extensions. But please consult an attorney

------------If he is working for the same employer who filed his latest H1 then he is on H1 and can file H1 Extensions
