Hi, I would like to know which is faster "consular processing" or "Adjustment of Status"?. I have received the choice of agent and address form, NVC fee bill and DS-230 forms.. I am already in the US. My priority date is not current yet..I am in FB2 category, gc parents applied for I-130.

But, I have to inform NVC regarding AOS if I intend to do..

I was told that CP is much faster than AOS. Is it true?
Should I proceed currently as for CP and later on if I want to change to AOS, can I do that?

Please let me know..

Thanks,

It depends on a number of factors, including the speed of the particular consulate.

If consular processing was already selected on the I-130, and the I-130 is already approved, it probably will be faster to finish it up with CP instead of switching to AOS, unless the particular consulate is known for being very slow. Switching would add some delay to the process because of the need for them to transfer files and prepare for the other option. But if AOS was specified from the beginning, staying with AOS probably would be faster.

thanks for your reply..

Yes, I-130 was approved in 2005. When it was filed in 2003, I was in India so my parents have selected for CP at that time..In my case, it would be Mumbai consulate..

I came to USA in 2005 on F1 visa and then got my H1b visa..

But in any case, only when the priority date becomes current then only we will get an interview for green-card? Is it true? or in case of CP, do we get an interview before the priority date?

Please reply me..

Thanks,

If you're pursuing AOS, the interview can happen when the priority date is not current, and even before the I-130 is approved.

But for CP, the interview will always be after the I-130 approval and after the PD becomes current.

O really..I was told that I cannot apply for AOS until the pd is current. I checked on USCIS website, it also says the same. I am in F2B category- unmarried children over 21 of gc parents

I was told that if I apply for AOS before pd is current then it will be rejected..

That is correct. But after you apply for AOS, the priority date cutoff can move backwards, making your PD no longer current. While you wait for it to become current again, they can interview you.
