Where 485 will be filed?

I am working currently in Jacksonville, FL. My company is based in Vermont. I was wondering under which center would I fall for AOS. My Labour and 140 were processed in Vermont

We spend enough time on this and Applied at the 140 approved Service center (VSC) I live in NSC Service center jurisdiction.

I even spoke to IIOs and they also said the same thing.

Do not waste time researching on this subject, send your application where the i140 is approved.

You weigh the options..

You currently reside in jacksonville
Are you planning to roll over to your client after GC approval or after getting EAD?
Do you thin that market can handle your skill set for some more years?
Then file it with TSC.

Your company is in vermont.
You do not want to make your employer suspicious and want to keep them humored.
You do not want to risk an employment RFE and question on intent by the INS when you apply for EAD and when appearing for the interview..
You want employer and lawyer to take major resposibilities including paying for EAD/AP.
Apply in VSC.

The discussion link mentioned missed out on some of the above subtleties.
Whatever you do, do it fast.

After checking the followup e-mails I think I should apply from vermont...
I was also wondering how will 180 day rule would effect if I decide to roll over in florida
 
Sorry, correction here!

Your AOS must be filed under the INS Service Center that covers the place of your residence. So, I think you need to file under Texas Service Center (I think it is TSC, but please check it out with your lawyer). If you file your case with Vermont, there is a good chance that INS may transfer your case to Texas. We have seen that happen to many individuals on these discussion boards. I apologize for the error in my last message to you.

Consult an immigration lawyer and do the right thing. Transfer of your paperwork will definitely delay the entire processing.

If you do not presently intend to remain with the petitioning employer "permanently" after the GC is approved it is immigration fraud to file an I-485. I realize that it would be difficult for INS to prove this intent, but that doesn\'t mean that people should give advice in this forum which expressly talks about "planning to roll over to the client", having the employer pay for all the associated expenses, and avoiding possible problems with questions regarding intent.

Jaxen clearly understands that it would be immigration fraud to do this and he\'s telling you how to do it anyway. Irresponsible if you ask me.

where to file?

I think it has to be service center that has jurisdiction over the place of residence. The biographic forms ask the candidates to fill in all residential addresses in at least last 5 years. AOS application is not about the company, it is about the candidate. I have seen people\'s cases being transferred to their respective service centers if they were filed in the wrong center. It is your decision on what you want to do, but check with your lawyer instead of wasting your time on the board.
 
Tell it to INS

The info on the INS website seems to indicate otherwise. I know that it used to need to be filed at the service center with jurisdiction over the residence but I thought I saw something a few months ago that said that you could file at the service center that approved the I-140 (which would be the service center with jurisdiction over the future job location) too so I looked on the INS website and that\'s what I found. INS officers sometimes transfer cases erroneously.

You\'re right, there is somewhat conflicting information there but the I-485 form itself is almost 2 years old and cannot be changed easily, while the information on the INS website can be changed any time. It\'s not a real disaster either way since the worst thing that will happen is that the case will be transferred.
