My employer has given me layoff notice for the next month i.e. Feb 2016. Currently, we are living in the USA and would like to stay for the next few months to complete my kid's school year and sell the house if needed. Both my kids are born American Citizen. Please provide the guidance on the following questions:
1. Currently, I am working on a TN Visa (Canadian). From earlier posts, it is clear that I have to apply for a B2 Visa and mail in paper application. My question is when to mail papers for B2 Status to USCIS i.e. before my last working day (how much time) or on the last working day (our current I94 expires in 2017)?
2. My wife is not a Canadian or Mexican citizen and she is on a TD Visa. Assuming, after the B2 papers are mailed (B2 pending status), I find an employer who applies for my new TN Visa: now, my wife is either B2 pending status or B2 status, for both cases can she file for the TD Status without leaving the USA or she has to leave the USA to get another TD Visa?
