when to apply for H1 b

I have F1 visa with Optional practical training valid till may 2005, Iam working
My comapny is ready to sponsor.

When can I apply for H1b visa, they say H1 cap is over, so can i apply for H1 now or should i wait till april2005

can i apply in premium processing or regular one , does premium processing really help

How long will it take to process H1 visa

You miss the Y 2005 boat, you should have applied during month of Sep 2004 premium process with start date May 2005.(INS entertain this request) (Bad luck)
Inorder to get new H1 B you have to wait until Apr 2005 for Yr 2006 H1 Quota. Even if you get H1 , the start date will be Oct 1, 2005.

Consult your attorney, how to maintain your status between Apr 2005 to Sep 30, 2005. (Chances of you be out of statue between apr - oct 2005. r
