use AC21?

My husbands original company is finished here in 6weeks time. He has a job to go to (he has already started part time).

When should we contact company attorney to tell him of the changes?

Do we need the new company to sponsor us now?

Original company will not revoke I140.They have said they will do all to help us get GC.

Appreciate any feedback!

Since the I-140 was approved and the I-485 has been pending for more than 180 days, he can change his job any time he wants.
He can inform the current employer when he tells them that he's leaving.
His new employer does not have to "sponsor" him but does need to support him under the AC-21 clause. Have him talk to the attorney of the new company.

Thanks NJ SKM.

Can we not continue with the same attorney?

What does the new company need to do with the AC21? Does it cost the new company anything?

You can continue with attorney. He should have dual representation agreement with you and your employer. All the new company needs to do is to provide an employment letter with job description, Title and salary. Talk to employer. Some employers will not give the letters in the required format.

-------------------Better to Hire your attorney OR let the new Company attorney Represent you. if you dont do all the info or any RFE will go to Past
Company attorney. you can also revoke the G28 filed by past company attorney and Can request the USCIS to send all the future Communication Directly to you on your Home adress.....

Thanks everyone for all the information.

There is no problem with the old/original company, they have just finished their contract here & are going back to the UK. They will do everything to help us get the GC (we are friends now after a long business together).

The original Attorney is very good & on the ball & we would prefer to keep him if possible.

We are doing a conference call next week with "old" employers to see how to go forward on this as the other 2 directors were applying for GC's too. I know one of them is forgetting all about his but I am sure the other is going to go ahead with his, although I do not know how he will be able to since he no longer has business here.

Also, the old/original company are paying for our GC & are still prepared to do so.

I will let everyone know what happens next.

Thank you all once again

I got my GC recently. I used the same attorney from the company which filed my I-140. Attorney just work for money, so it is ok as long as he is not that kind of attorney sitting in your old company office.
