hi all
applied 485. my dependents(on h4) wants to go to india for 3-4 months,
while they are out of US and 485 approved:
    1. what is exact procedure to get in US? just come here and get the stamping
    or
    2. do we need to something at POE? is there any kind of issues?
    3. do they need to come immediately here for stamping?
    4. continue to that question what if primary applicant is out of US and
    gets approved?

any useful links to this subject?
has anyone gone through same before? please explain.
please your replies are greatly appreciated.

    thanks
    r2b.

I have the same situation

I feel it should be ok to come back and go for passport stamping. Let see if any body else can comment on this.

is Advance parole required? why?

hi
can you explain why? and do i need to specifically say to POE office about this?

thanks
r2b.

because your H1 is no more valid. INS has a rule that "Last action rules"

So your last action is 485 approved and it invalidates previous status.

Can use H1 to enter...

If the h1/H4 are valid, enter on that status. Then go to the INS office to get the stamp. If you are using AP, and I485 is approved while you were away, the AP will be stamped with deferred inspection and you will have to go to the INS office within 14 days or so.
This is based on the previous experiences. See the archives...
