What's Paroled Until ... means?

Just came back using AP, everything is straight forward. As somebody mentioned, it's designed to help you travel, not to trick you. Now the questions:

- I have to switch to EAD instead of H1, right? My H1 is a working permit, not visa.

- I saw two dates on AP, one is valid until 06/17/04, which is apparent. The other is the stamp saying Paroled Until 07/10/04. What's that mean? Anything happen on 07/11/04?

Thanks.

It means that you have until 7/10/04 to get a renewel AP if your AOS is not complete by that time.

Thanks. But I heard AP is always new, not renew. Anyway, with a Sept. ND, any chance my case get done by next June? Hope the 180 day rumor is real.

The date does not mean anything. You can use the same AP until the paroled until date. You need a new AP for travel after wards that is all.

IF valid AP is more than 1 trip or Mutlipal trip you can use it till the date it is valid

Thanks for the great information.

What I haven't figure out after reading: My H1 is a work permit, not a visa (that's why I use AP). Is the H1/L1 status mentioned apply to both?

Paroled Until - Date

Folks

My first AP was valid only until June 14,2003. I reentered on March 21st using AP

The officer at POE stamped Parole document with the handwritten comment

Paroled until "March 20,2004"

Does this mean - this supersedes the original expiry date of the Advance Parole(06/14/2003)?

Was it just an error by the immigration officer at port of entry?

Can I safely rely on this and travel out of US and reenter on the same Advance Parole document even though the original document says valid until June 14th

I have applied for Parole Renewal

Notice Date is 7th April 2003

God only knows when that will come through going by the various posts on this forum

I tried to read the Immigration Act - Section 212 and could not come to any conclusion

Hi hsubbu,
Ur AP date is the date which u have to take into consideration. The 'paroled until' date, is usually 1 yr after the date u enter US. SO after june 14, 2003 u need a new AP.
There was a posting with the exactly similar situation yesterday or the day before. The person was not allowed to enter US on AP as his actual AP had expired, eventhough the I-94 stated otherwise. But he was able to enter US using his H1 which was also valid.

yes it is still valid
your status is H1B, just because you don't have the H1B visa on your passport doesn't mean that your status is changed.
The only point of concern is what happenes if you go to a consulate and apply for H1B and get rejected, and then re-enter on AP. Are you still on H1B Status or not at that time :)
But if your H1B wasn't ever rejected then you don't have to worry
you are still on H1B, i had asked my lawyer about it, and you should ask your lawyer to make sure

Thanks.

Update. Lawyer just confirmed. Not sure why but felt I might better off extending H1, even into the 7th year.

Under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, aliens who depart the United States after being unlawfully present in the United States for certain periods can be barred from admission, even if they have obtained Advance Parole. Those aliens who have been unlawfully present in the United States for more than 180 days but less than one year are inadmissible for three years; those who have been unlawfully present for a year or more are inadmissible for 10 years.
