hi guys ..

I am asylum and I will marry next summer but my fiancé is on a visitor visa. Can she adjust her status through me? Is there any way to adjust her status? What are our options? School option is a killer for me .. and green card is gonna take forever by that time I will be too old ..

any input or advice ..

You can't do anything..I dont think your fiance can even change to student visa because they dont allow it after 9/11. To change a visitors visa to student visa..you would have to tell the immigration officer at the airport and he would stamp "prospective student" on the I-94...then if she decides to study she can change her visa...

She can go back and apply for student visa
 
Its a hard fact that CIS is totally screwed up when it comes to marriage with Non-US-citizen "AFTER" asylum approval. Either you write your spouse's name in Asylum application, BEFORE asylum approval or wait until you get your green card. Now those people who got their asylums in 2004 would get their GC somewhere in 2011. So are they suppose to wait till then to get married. And even after getting GC, it takes 2-3 years to bring spouse on GC.

This is totally screwed up but thats the way it is.

Are there any grounds for her to independently apply for asylum? Has her relationship to you caused her some grief back home? (Assuming you are both from the same country and the people who kick ass in your country have made the link between you and your sweetheart!) Talk to an immigration lawyer.

wantmygcnow .. she can go to her country and get student visa .. but how long she got to study ? 10+ years !!!!

TortFeasor ... she is not from my country .. so she can't apply
 
Waitinglifetime, Thats how the laws are my man..You can't do anything about it. As one lawyer put to one asylee "Dont fall in love with a non-immigrant Visa holder"
 
green card asylee and marriage..?

anyone knows...
we as asylee are not allowed to go back to home country even after green card.then if we wan get marry to a girl from home country.what's are the ways.if she come here on non-immigrant visa ...chances are less to adjust her status cuz of intentionaly (immigrant) got non-immigrant visa.so can we go to third country and get marry there..? or there are any other ways...?
let's discuss on this..!

I hear you Paramvir1 ... coz of this asylee .. I feel like my right to get married the one I love has taken from me.

what do you mean by third country ?
 
actually this is another reason to start new lawsuit against BCIS.why cant we get married whoever we want to :cool: ?i think you should get married and file derivative status for her .You should consult witha good immigration attorney .
