The "age requirement" is for sponsoring a parent or sibling via an I-130---for that, the USC must be 21 or older. Theoretically, the youngest legal age for marriage (with parental and judicial consent in "special cases") is 12 at least in Mass. and 13 in New Hampshire and 16 in many states. The problem with these cases for an immigrant petition is that the I-130 sponsor MUST also submit an I-864 which is a legally binding contract. The question then is: Can the sponsoring spouse legally sign a contract?
Is the USC spouse old enough to sign a contract?
The alien spouse is not similarly situated as the sponsor.
