What happens if H4 extension and H4 to H1 COS are processed simultaneously?

Hello Gurus,

What happens if H4 extension and H4 to H1 Change of Status for a same person are processed simultaneously?

My guess is last one approved is what is valid.

Please let me know your comments/suggestions.

In this case there is always an alert triggered by INS. Your attorney will get call definitely from INS.
If your H1 is approvable, then INS will ask you withdraw the H4.
You have to withdraw H4 as soon as h1 is approved. This situation go for h1 perimium process, so that you know results with in 2 weeks. (Before approval of H4)
