Attention: Mr. Paul Novak, Director
Subject: Request to Expedite Adjudication Pending I-485 petition.
Dear Mr. Novak,
Adjudication of our I-485 petitions is delayed by about 10 months when compared to the current processing times published by Vermont Service Center ( October 22nd, 2003). It has been more than 750 days since we filed our application. The usual processing time as per the application receipt is 365 to 540 days.
Primary Applicant Petition details as follows:
Name: your name
DOB: your date of birth
Receipt #: EAC-03-xxx-xxxxx
Alien #: Axx xxx xxx
Priority Date : 02/14/2002
Receipt Date: 01/27/2003
Notice Date: 12/26/2002
Finger Prints Status: Vermont service center received our second finger printing in August 2004
Derivative Applicant Petition details as follows:
Name: name
DOB: date of birth
Receipt #: EAC-03-xxx-xxxxx
Alien #: Axx xxx xxx
Receipt Date: 01/27/2003
Notice Date: 12/26/2002
Finger Prints Status: Vermont service center received our second finger printing in August 2004
Reason for Expedite Request:
• Adjudication of the petitions delayed beyond the current processing dates published by Vermont Service Center. The current published date is October 22, 2003. This is about 10 months beyond my receipt date (January 27th, 2003).
• It has been delayed way beyond the normally accepted timeframe mentioned in your receipt notice. (365 to 540 days). As of today it is already more than 750 days. This almost twice the average time you have specified on your notice.
• As per your response earlier, my underlying I-140 petition has a priority date of 2/14/02 (Country's name) and the Department of State is currently issuing immigrant visas under the category applied for with a priority date of March 1st 2002 (regression of priority dates).
• The delay in adjudicating the petitions is causing us financial expense to apply for multiple EAD’s and Advance Paroles.
• As per FBI, a name check for the both of me and my spouse was completed on xxx xx, 2003, and the results were forwarded to the U.S. Citizenship and Immigration Services (Please see the attached email correspondence for further information).
In view of the above, I would kindly request you to look into my case and approve at the earliest. If there is anything that I can do to help, please let me know.
Sincerely,
Your Name
