What can i do next- AOS interview further review

Hi, everyone:
Thank you to everyone that provides helpful information.Here is my situation:
Me and My husband(USC) went to AOS interview in SF today. The officer is nice and she asked lots of questions about my previous student status and the interview lasted about 40 mins.

I came in 2007 as a student, i fell out of status last year because the "famous" Tri-valley Universtity. I applied for reinstatement last March with another school, and got response asking more evidence back in Last Nov.I married my husband last October after we know each other for half year. So i am sure i am out of status. Last month, i got a denial letter of my reinstatement citing i did not reply with needed evidence. Since i got married, we applied GC back in Nov. So i did not respond to them about the reinstatment.

We brought joint credit card, photos, joint tax return for year 2011, healthy insurance, adoption paper of animals we have together. We had 20 photos there in the album and she was asking: are those all you have? I said: We just picked out the best we thought.

Since my husband worked 2 jobs to support us, (i have no income), he can't get enough time off, so there was no honeymoon or trips for us. We planned to go back to my country after i got the GC. And we met in the house which we are currently living together in. So we were roomates before we got married?

At the end, she handed us a paper saying: she can't make a decision today, further review will be needed, but we should get a response in mail in 2-4 weeks.

Here is my concern:
1: Will my out of status a big problem which makes it hard for her to decide my eligibility?
2: I heard there is one interview so called" Stroke interview" if they have doubt about your marriage. Will we get one? But she clearly said nothing need to be done on our sides.
3: What can we do if she deny our case? Can i appeal?
4: She also asked for my I-20s, my husband's citizenship certificate, SSN. We did not bring them , so she said it is ok.
5: What can i do next?


Please help! I got so upset and i was thinking maybe i have to leave my husband to go back to my country if got denied. Our marriage is based on good faith and i entered with valid visa.

So you had no intention to continue with your education for which you initially came to USA? You should have sent the required documents for the reinstatement, regard less of your marriage.

The main potential problem I see is that it may appear to a suspicious mind that you got married solely for the Green Card because you knew you would not be able to satisfy the Request For Evidence. You may be approved, or you may get a second interview. Wait for a few weeks. In the meantime make sure you're living together and accumulating more joint documents.

Yes you were Out of Status however being out of status is overlooked when you marry a USC so far as you came in with a valid visa which you apparently did.

Yes you can appeal if/when she denies although it is very likely you will not be denied until after a second [Stokes] interview.

Gather all the documents she asked for and have them ready if/when the request another interview.

Finally, relax. She might approve you in the next few days.

I observed from posts usually they take seriously F1 to GC status changes.

Were you roommates before getting married? Your husband also a student?

Are photos covering dating period and after marriage period? How your marriage was done, i mean any ceremony with family/guests?

1. No problem. Its forgiven in marriage cases.
2. Chances are there that you'll get Stokes interview. Better prepare extensively.
3. Even if they deny, its' not end of the road. You can appeal in Immigration court, and further too. But that route is not recommended as it'll take long time and money.
4. What you gave earlier as proof of yr husband's citizenship?
5. Wait for their decision, and be prepare :)

Thank you, BetterWorld.

This is the first marriage for both me and my husband.
He is working all the time, he is not a student.
Our ceremony is small, since my parents are still in my home country. Photos cover most after our marrage.
The I/O did not mention anything about second interview or further documents. She just said we should get response within 2 weeks.
My husband brought his passport, and she said she wanted to see the citizenship certificate.
Still waiting, hope we do not need to go down the appealing road.

That response could be an approval, an RFE/RFI or an invitation for a second interview. Think positive. Best of luck.

It have been 1 months since we went the AOS interview. I still have not get any response from them. I called the USCIS service , and they said my application still within the normal processing time. We filed the application on 12/01/2011, that is 4 months ago. I don't know what went wrong with the interview.
My concern is : What will happen, how long will it take for them to request a second interview? What can we do while waiting? Is there any possibility that it will take them more than 1 year to approve my application? So comfused.

Any advices, please?

I'm very sorry to hear that your application is still under review. Unfortunately you can only wait and see what happens. It could take a while. I read about few cases where it took up to 10 months. You can also try to consult/hire a lawyer and see if they can do anything do speed up the process. keep us posted and I hope your application gets approved soon.

It is not uncommon for them to take a month or two after the interview to complete the processing of your case. Wait another month before you start getting concerned.

Do they delay to do some investigations like home visit? What is the possibility? (Don't want to scare you rebecca18, just curious :) )

Proof of citizenship- US passport is sufficient or one needs any other document?

A1: Thdy can take as long as they want. You should schedule an infopass once a month if possible.
A2: See above
A3: Hopefully not, but it is possible

They did not do anything like home visits. Nothing has happened after the interview.I think they may be doing the background check, since i was out of status( F1 visa).
I called to ask if i can schedule an appointment through Infopass,i was told it is still within the normal process time.
I have the EAD card already, fortunately.
But i heard about that if i won't get the 2 years temp card, after 2 years marriage, a 10 years GC will be granted. Is it true?
 
One gets 10 yr GC, if his marriage is over 2 yrs old at the time of GC issue. I don't think merely being Out of status triggers the background check.
BTW, what they do in this background check? Is it mandatory in all cases?

When do they do home visit (if at all they want to do) is it before AOS interview or after?
But i am sure they do it before approval. Obviously after approval it doesn't make sense.
Any thoughts guys? Jackolantern & BigJoe5 pls...

Do we have any home visit experience with our forum members?
