Thank you to everyone that provides helpful information.Here is my situation:
Me and My husband(USC) went to AOS interview in SF today. The officer is nice and she asked lots of questions about my previous student status and the interview lasted about 40 mins.
I came in 2007 as a student, i fell out of status last year because the "famous" Tri-valley Universtity. I applied for reinstatement last March with another school, and got response asking more evidence back in Last Nov.I married my husband last October after we know each other for half year. So i am sure i am out of status. Last month, i got a denial letter of my reinstatement citing i did not reply with needed evidence. Since i got married, we applied GC back in Nov. So i did not respond to them about the reinstatment.
We brought joint credit card, photos, joint tax return for year 2011, healthy insurance, adoption paper of animals we have together. We had 20 photos there in the album and she was asking: are those all you have? I said: We just picked out the best we thought.
Since my husband worked 2 jobs to support us, (i have no income), he can't get enough time off, so there was no honeymoon or trips for us. We planned to go back to my country after i got the GC. And we met in the house which we are currently living together in. So we were roomates before we got married?
At the end, she handed us a paper saying: she can't make a decision today, further review will be needed, but we should get a response in mail in 2-4 weeks.
Here is my concern:
1: Will my out of status a big problem which makes it hard for her to decide my eligibility?
2: I heard there is one interview so called" Stroke interview" if they have doubt about your marriage. Will we get one? But she clearly said nothing need to be done on our sides.
3: What can we do if she deny our case? Can i appeal?
4: She also asked for my I-20s, my husband's citizenship certificate, SSN. We did not bring them , so she said it is ok.
5: What can i do next?
Please help! I got so upset and i was thinking maybe i have to leave my husband to go back to my country if got denied. Our marriage is based on good faith and i entered with valid visa.
