what can i do??? I-751 pending too long

I am conditional GC holder,through marriage and i am now divorce. i went up to immigration in 2000 and they stamp in my PP I-751 pending and again i was call up in 2001 and again i was stamp I-751 pending, i was call up in 2003, they took my green card and say i will hear from them, well its going to be 11years and i can't hear anything. What can i do??. I have my mother who is a US citizen, can she file for me, can i forget about the first case and let her file for me. Any thoughts will be highly appreciated.
 
Have you made an infopass appointment to find out what is delaying your I-751? Do you know you can apply for citizenship even with a pending I-751? That will force the adjudication of your pending I-751.
 
Thank you for replying, i did the infopass and they couldn't find my file and they told me they will look into it fo me, but its almost four months now and can't hear anything, i am going out of my mind here. Eventhough they took my green card i can still apply for citizen???.
 
After your divorce, did you file a new I-751?

What you mean " I was call up and they took my green card"? Did they send you a note about you must surrender your green card? Did they tell you why?
 
When i first came here, i came with a two year CGC, which would have expired 2000, but they renew it for 2 more years, then it was expiring in 2003 , so they send me an appointment letter for an interview, with my spouse, but she didn't go with me, because she had already file for divorce, so i went up alone, there is when they took my GC and then they stamp my PP saying pending I-175 and they told me i will hear from them, it been almost 11 years since i came here and i can't hear anything, no decision. I went up with an infopass and they can't find my file, so i don't know what to do from here.
 
I had a lawyer who keeps telling me to wait, things will change with the law and I may probably have to face an immigration judge . I have contacted them plenty of times, first they couldn't find my file, next they said i should forget about that case and let my mother file for me. And so the years keep passing by with a pending case. Well now i need a decision from them.
 
Find another lawyer.

Contact a congressman to see if they can work something out for you. That was way too long. If you PR status is still valid, you should have applied for naturalization 5 years ago if you filed your I-751 in 2000 (so I suppose you got your 2-Yr GC in 1998).
 
Yes, thats correct i got my GC in 98, so I am still a PR, but the only problem is the case for I-751 is pending. The first instance they should have gave me a new GR with another expiration Date, or worst case scenario deny or revoke my GC, but they didn't, they just took it and stamp my PP - case pending. Do you now if anyone has ever gotten any reply from the Obudsman???>. Please let me know.
 
You DEFINITELY CAN file for N-400 even when your I-751 is still pending. Then USCIS will speed up the process of your I-751 application and possibly find out what went wrong in your I-751 case. I think you may need to file for I-751 waiver since you mentioned you divorced.
 
You could have applied for citizenship a long time ago (n-400) and that would have forced your application to remove conditions (i-751) to be adjudicated... a good lawyer would have told you that.
 
Thank you all for replying, The lawyer i have keep telling me he don't want to bring up the case because i may have to go in front of an immigration judge and i he don't know what they will do .
 
Either way you may have a chance to be required to show up in front of immigration judge. Waiting doesn't solve the problem.

I highly doubt the professionalism of your attorney 'coz I think he is supposed to solve the problem and face the judge with you, that's what he got his bucks for! Don't you agree?
 
Actually to go in front of an immigration judge not all the time is bad, actually can help to move your case especially on I-751 issues that are pending for no apparent reason.

I would change lawyer asap...remember you are the client.
