What about those graduting in May 2007? Please response!

Hi
This is my situation! I am an International student. I will be graduating (MS) this May 2007. My OPT will start from July 07 and will end in June 2008. I got an offer from a company and they applied for my H1 on April 2nd with my BS degree credentials with premium process.
Now which category I fall in? Do they count student graduating May 07 in 20K cap?? Or do they give any priority to them? What will happen if I don't get H1B this time? Next year even if I plan to apply for H1B what will be my status in July, August and September 08? First two months can be counted as buffer time but what about September 08??

Please let me know!

If you miss this year H1, you can work with same employer with your OPT. Next year April 2008 you can apply your H1. Untill then you are in OPT.

You can not work for some time

Great Guru is right. But, when you apply for H1B in April 2008 it will only be approved effective from Oct 2008. So you should not be working between July 08 and Oct 08.

What will be my status in July through September 08. Considering July and August as buffer time what about September? Will I have to leave US at that time. According to laws I will not be valid at this time in USA.
 
You surely are out of status after July.. But according to USCIS, you can take a 2 month extension after your OPT expires within which you can try and change your status.. This extension can be taken before and after OPT.. so if you are not taking it before.. you can take it after.. so that means that you can stay in US till Sept.. lets say if your OPT starts on 1st July, then you can stay here till Sept. 1.. but then you have to see as to what to do for that 1 month between Sept and Oct.. I guess if you file for premium processing for your H1, you can get your H1 by end of May.. but still you H1 begins on October.. but maybe there might be a clause that you can stay in US once your petition is approved, but I am not sure of this, so you need to check it with somebody on this..
