Weird thing happend on H1B approval.

Hi Guys,

I got some weird issue. I came here on H1b in Jan'01. So the total 6 years will be ending in Jan'07 right? but when i applied for extension, I got approved until Jan'08, exactly one year in addition. Is that right or wrong? good or bad? I donot know. You guys had any same kind of situation? what should I do now. Just keep it or correct it?

Please help me out.

INS mistake never taken as granted.

RE: H1B extenstion

Don't worry,It's because of new rule that's been passed few years ago.If you're in 6th year and say applying for extenstion,. you might get it for more than an year.

It is your responsibilty to make sure the time lines.... you attorney should have filed the paper work using the correct date for From ...... To columns....
They don't check when the person came here first time.... so they just approve it based upon the dates you have mentioned... max three years at one time
 
You are still bound by the Jan '07 date .... irrespective of what the approval notice says.

Be careful ... USCIS can (& will) quickly shift the blame on to you if you stay in H status after Jan '07.

Actually I completed only 4+ years. my second extensions is expired last month. so I applied for remaining period. thats how i got this confusion. You think I should inform to INS directly or my employer has to do?

No need to inform the INS

The only thing you have to do is either you file your I485 before Jan 2007 or get extension... or go back before date date......
 
I verified with my employer. They actually applied with my 7th year extension. so I guess I am fine. :) But I have another question. :confused:

In case for some reason if I change my employer, do you guys think, I will get the H1B will be approved until 2008 (including 7th year) or will be approved only until 2007. I donot have any copy of my labor filed with current employer and I may not get one.

Ext of H1B

I think the extension for the H1B visa is always done one year at one time.. i don't think you can combine it with some thing else....
