Weird Situation : Six Months after Fingerprint But No Reply !!!

Hello...to all experts and other members of this forum. This is regarding my wife's N-400 case. Her time line :

(Newark, NJ state)
Mailed N400 : 07/17/09
Priority Date : 08/03/2009
FP Appointment Date : 08/23/2009
Walk-In FP date: 08/19/2009
Online status changed (Case transferred to local office for interview) : 09/07/2009

[ My wife got her GC in July 2004 through family based file] .Since then she visited her native country once in a year. No visit was more than 6 to 7 weeks long.

Now...4 months passed without any progress so, my wife took Info-pass appointment on : 01/08/2010

(The representative tried to find the details on the computer by entering N*........... number. She tried for few minutes and then told my wife just wait there and she went upstairs in that building. She came after 15 mins and replied my wife that she will hear from USCIS very soon. )

By the end of January,2010 we moved to Texas with 3 to 4 yrs stay plan (Because,I got admission in san antonio, Texas). We filled a form AR-11 (for change of address) in proper time limit.

In the first week of february,2010 my wife called to newark,NJ office for update. The representative told her that if, during Infopass appointment they replied you to wait then you should wait. So, not firm answer from them.

In the end of Feb,2010 she contacted one of her family friend who is immigration lawyer in NJ. He use to visit regularly to Newark field office for his client's cases. He has couple of known people inside that office. Through one of his known person we come to know very unusual fact that they have kind of two systems for files arrangement. In one system my wife's file was not at all showing but in their internal system he found out that the file is there but they haven;t put in interview schedule line because of some reason. Either they forget to put before 3-4 months or due to some unknown reason. That family friend lawyer told us that he will look into this matter through his couple of contacts but he also suggested that be ready for Re-application ( Thats so, annoying and frustrating ??!!). Whats the guarantee that they won't do this blunder again ?

One of my friend applied almost 2 months after my wife's date and he got his citizendship in January,2010. So, I think if, we sit at home by doing noting then they won't reply for next 25 yrs also. Because they got their $ 600 + .

So, please, give your expert suggestions what should we do now. (I am on F1 visa and dependent on my wife. I maintained my legal status throughout since last 2 yrs. I don't have any intension to violet F1 visa law till my wife will get her US passport. Then we will think for my AOS filling. But thats a different issue.)

Please help us and reply urgently..

Writing to the CIS Ombudsman is a good idea, but I also suggest that you contact the two U.S. senators for your state and the member of the U.S. House of representatives for the area where you live and ask them for help. All members of Congress have staff specially trained to deal with constituent requests, particularly on immigration matters. CIS responds to congressional inquires faster and also provides more accurate information compared to inquiries from private individuals.
Since you moved recently, you could probably ask Congress members from both Texas and New Jersey for help.

Which is the best way my wife should contact the two U.S. senators for NJ state and the member of the U.S. House of representatives for the Wallington,NJ ? I mean to say An e-mail or a letter with certified mail and/or a simple call to their respective offices ? If, they won't reply promptly then we can directly contact USCIS Ombudsman's office. Is there specific form we need to form for that office or writting a e-mail or official letter would be enough ?
**** I still cann't understand why they intentionally skip certain files and put them aside ? :confused:
please guide me further for above mentioned doughts. I am really thankful to you people for your vital advices.

follow Bobsmyth's advise and contact ombudsman office first. Also if you know the director of that DO , write a letter to him/her.

The Ombudsman is there to act as a liaison between you the customer and USCIS. They have their own internal resources that are able to investigate your case status when the USCIS process has broken down.

While you are in the process of sorting this out, you need to notify USCIS of your address change. Filing an AR-11 is not sufficient if you have a pending application. If you haven't already done so, you also need to call USCIS at 1-800-375-5283 and let them know you have a pending application and that you need to change your address. You risk losing your application related mail or risk having it sent back to USCIS without this step. http://www.uscis.gov/addresschange

Thanks "sunnny808" for your suggestion regarding address change formality. We have filled online address change form as well as paper formate (signed) form through certified mail. Also, We already have received confirmation letter mentioning that our address has been updated in the system from USCIS though, it looks like automatically generated ( Not signed by any one). Besides that we had requested USPS to forward all the mail from old address to new one and so far we have been receiving all the mails from previous address. So, i don't think mail related issues will happen. and my wife moved in late january 2010. So, she should have received something Between August 2009 to January 2010 ( 5 long months after fingerprint.... Thats equal to current national average process time for N-400 from start to end).
 
Dear all experts of this forum,
I have few questions in my mind after sending Form-7001 to CIS Ombudsman.
[1] How much time this agency normally take to inquire about my wife’s file ? [On internet through other source I come to know that within 45 days one can hear from CIS Ombudsman. Is this true or its variable according to case complexity ?
[2] If, nothing will happen in next 45 days what are the options left for us ? Do we have to reapply from start.( A new N-400 application with $ 650 !)
[3] If, we have to go for new N-400 application since, we moved to texas in late January,2010 when my wife will be eligible to apply ( As she has to prove her residency status in new place…may be 90 days…I am not sure). So, which will be the appropriate date for re-application ?
I am on F1 visa since Mid-2008 and my visa will be valid till May 2013 ( My graduate study will be finished in 2013 also). We married in Feb,2009 in NJ. Because my wife married to F1 status holder, USCIS is not looking favorably towards her case for naturalization. Is there any possibility of such reason?
