Want to obtain my F-1 visa for MBA

Hello all,

First I have to say that I finished my bachelors in engineering from a university in the states, and was working on my OPT. My company applied for my H1-b but unfortunately did not get through the lottery, as it was under the undergraduate cap. I started on another degree after my OPT expired, however I stopped after the first semester and decided to come back and work in another country for a year -year and a half.

I have decided I want to do my MBA in the states. However I am concerned that my previous H-1b application (it was not selected in the lottery) would make the consulate deny my application purely based on this.

Does anyone know if this is the case?

Thanks for the reply. When you say dual intent, what does that mean?

As I understand it, the F-1 is given based on the fact that it is only for a non-intending immigrant to solely finish their studies and move out of the states. So applying for an H1-b (even though it didn't get picked up in the lottery) proved that the individual is immigrating correct? So when the consulate looks over the new F-1 issuance for my masters, would they deny this based on a previous H1-b submission?

It is currently in the works. However I was weary that this situation would bar me from obtaining an F-1 so I was worried about it. Not getting much night's sleep thinking about it didn't help either. I pretty much may go to the same school as I got my BS in Mechanical Engineering from (Huge school and pretty famous too!)
 
what you can do in the meantime is to ask letters from few professors saying that they ve known you and you have the capability to pursue graduate studies in X field.

What nscagony and GCman2005 said, plus if your H1-B application did not get through the lottery and not accepted, USCIS never even looked at it.

Was curious as if the H-1b/L-1 visa applications counts as "intent to immigrate", but I see that they are not since they are both classified as a non-immigrant visa.
