Want to marry foreign citizen - in the US through AOS or apply for K-1 while in diff countries?

Hi all,

My boyfriend and I want to get married. I am currently a permanent resident and will become, hopefully, a citizen sometime in November. My boyfriend currently has a 10-year visitor's visa - has already visited me earlier this year. We are thinking of him coming over again this fall, when I will have my citizenship. We would like to get married here in the US and then apply for adjustment of status for him. The other alternative is for me to file the I-129F while he is in his home country. We are tired of waiting on two separate continents. Has anybody been in this situation? What would be the best course of action? Pros and cons for one or the other choice. Is there any other way?

Thank you so much! :o

Easier to adjust status then the K-1 Visa. If he has a visa thats one avenue you can explore, remember when applying for entry to the US as a Visitor the intent should be for a visit. If you are eligible to apply in Nov, add six months to that for processing that is if everything goes smoothly.

Thank you, namecheckvictim. The only concern we have is that they might give us a hard time when they process the AOS because he would come as a visitor to visit for us to end up getting married... Is that called immigration fraud? Thanks.

Your post on this public forum is a clear declaration of intentions. So AOS cannot be called "spur of the moment decision". Go the K-1 route. Harmones can be controlled by us humans.
