Want to know your application is taking so long?

That is employment based, not family based. FB is taking long because of fbi checks not because of eb.

EB is handled by service center and FB by local offices. Nothing to do one to the other.

USCIS has been playing a lot of games with legal immigrant workers for a long time; whoever is handling the Visa Bulletin obviously does not have any idea of what they are doing.
 
MY AOS went on June. For some reason I never got a FP, my husband did. According to that report we'll have to wait another 2 years. I have been on this GC game from 2004. It does not compare to let say your case not being approved because you dont have to wait for a visa I did. So delays on AOS based on marriage to a USC, compared to Emplyment are nothing.

But i guess not every one is lucky enough to find real love and gc at the same time... I should have gone that way :D

Applications were already surging then as foreigners sought to file papers before higher processing fees took effect on July 30.

Yeah but 90% of the 300K are employment based, I dont think you are familiar with that process, they change the bulletin which allow some people to apply twice in 17 days.
EB are not related to FB, it does not have anything to do one to the other. EB are the ones in big problems right now, fb is not. FB is backlogged due to name check at the fbi. And USC spouses do not wait for visas, EB do.
 
I know. I know the difference also. I am just posting it partially as interest information.

However, like I quoted, partially (aside from namecheck) the high volume of filers trying to beat the July 30th deadline has put a delay on the notices for july/august filers.
 
Yes Employment Based we know since DOS published the July visa bulletin, they took it away, they published it again, the moved the August Bulletin as U, then they got some more visas from consulates , it is insane.
Without A new law lots of people will be stuck for years. Without recapturing visas we'll be stuck who knows how long. But only EB, FB is not affected bythis drama
 
I GUESS EMPLOYMENT VISA'S application is what brings mor money to the USCIS treasury.... well we'll just have to wait till they get to us.....lol
its true because they said only 10% of the total applicants usually gets the visas, based on the quota for the year.
So its business as usuall.
 
Employment visas and family based visas are like apple and oranges. They might be in the same store, but are completelly different. We go thru a lot of scrutiny on regard to our education, job etc.
And fb dont, because the benefit is based on a family relationship and eb benefit is based on the need of new workers in the country. It is very frustrating to get a GC thru the job, but at the end the process is almost self sponsored; if you are a good worker, most likelly you will get your gc. After 180 days basically you depend on you and in your capacity to keep a job.

you are right, you are basically sponsoring u're self. except you are working for a huge cooperation, the chances are usually very slim.... for most applicants.
 
Employment and Family based are totally different animals. I am classic example for that. I waited 6 year 7 months for Employment GC and still waiting. My employment based 485 was filled ages back and CIS didn’t even care about it. I finally got tired of that and filled AOS based on the marriage and here I am with a Interview letter!!!. What a waste of time and money but the good thing is I’ve got my EAD within 2 months of filling EB 485 so it’s no biggie for me since i can start working but there’s lot of EB AOS guys whose been waiting for years at the mercy of CIS.

well you were very lucky because you found a USC, but in cases like me, there is only one choice. And in a way I feel very proud that being a female I did not have to marry a person I did not love just for paper, because in my case, unless it is my hubby, any other option would have been unbereable. I am very happy with my choice. Being waiting for so long is frustrating, but marriage without love was outside of my pool of choice, and also I dont want anyone to say "I gave you the gc". I am sure that is not your case or many people here. But I have seen it happening. At least in my case I did not have to do anything but work (I mean in the office) to get my GC.
 
Tech, Mind what you are posting here…I am not lucky because my wife is USC…I am lucky because I’ve found my soul mate.
 
That is what I meant. You found both but that is not the case for the 300 K souls trapped in the backlog of USCIS. We cannot switch spouses for the GC. So you are very lucky. But many people can not even consider that option, so for us is not only a waste of time. It is a waste of life.
 
Godisgoodtome , not only that. If your application has not reached the i-485 stage and for some reason the company goes out of bussiness, you are basically back to square one; you lost the whole process
I lost one processs and 6000 dollars; I do not regret any of my choices but it has been 7 YEARS!!! and still no gc.... it is very frustrating.
Some days however, I watch my great job and my husband and things are more bearable, but yes it has been a long and frustrating road. But as I said for some people we can't have the other choice, although at the end it is basically all in your hands, no one can ever tell you I gave you this or that.
