Wages not paid as promised...

Dear Rajiv,
Had a question for you...

I work for a consulting company. We are all going through a bad phase.

Last year my company paid me only $40K as against the $50K that they mentioned as my minimum yearly wages in the Labor Application which was approved prior to the applying of my H-1B visa.

I was wondering if there is something wrong with it and if there is any way they can be asked to pay up in such a case...

Please help. Really appreciate it.

I think that a good way to make employer pay the balance money would be to get another job on H1 and then talk to lawyer, may be initially it will be free consultation and also the charges may be a % of what the company would have to pay in damages. This way you can sue the company and they may settle without going to court, but the end results would be favorable to you (All the above is based on the fact that you can prove that they did not pay you the agreed Salary)

It will be unproductive to sue for 10K now without another job in hand. agree with the responder...
