WAC-01 waiting for approval list

WAC-01-296-5XXXX - still pending.

My wife's case(primary applicant) is still pending. AVM and online status says "FP results received and Process has resumed..." Our cases were sent to the INS in the same package. Our fingerprints were received by the INS on the same date. My case was approved in June, 2002 and I received my card in September, 2002.

Meanwhile, in September we contacted the local Senator. The Senator's office made a CONGRESSIONAL inquiry twice in the past few months and the responses from CSC are the same standard BS. Inquiries were also made by our lawyer's office.

The following are some OFFICER responses received by the Senator's office and the lawyer's office.

a) ... case will be assigned to a SPECIALIST soon...
b) ... application is pending within normal processing time..
c) ... it may be several months before your case will be seen by an officer.
d) ...maximum processing time is 999 days....
e) ...somehow the spouse's case joined a faster group with fewer cases.
f) ...every case is different...

In my opinion contacting your local senator or congressman is a complete waste of your time. They give the same standard BS answer to everyone. Who knows, every lucky 25th caller may get a honest response, everyone else try again. We pay fees, yearly AP & EAD renewal fees, taxes and these OFFICERS sit there lying to us through their teeth, that it just boggles our minds.

On the other hand, I assume it's their close RELATIVES who are crossing the borders illegally by boat and receiving their green-cards in a year.

I have received a mail from my lawyer regarding the fax inquiry to INS. It says "Case is currently with an officer awaiting for adjudication."

Is this is the standard reply from INS (just to save their ass)???
 
Per my attorney my case was assigned for final adjudication on 10/15/02 to an officer who had not so far done it.
I made my attorneys talk again with INS (IIO) who had assured that he would present the screen print of my case to the supervisor who is expected to 'talk' with the officer to who my case is assigned.
 
My attorney says the fax did not had a case assigned date. I think I'll wait for some old timers to get approval first. After that I'm planning to send another fax.

If I Used AC21, should attorney mention on Covering letter about AC21 ?

No significant change in my case. We are about to start fax enquiry next week because then 60 days completed after INS received RFE response.

I sent a fax...but I did not hear back from CSC. My attorney was
about to do a fax inquiry this week but f...ing JIT screwed the
whole thing....

After Fax inquiry on 11/16, the AVM changed to processing resumed...from the old 975 days message..

I checked the online status yesterday and it said 'RFE issued on 11/25'.

Now waiting for the RFE.

Still no luck. The AVM and the online check still the same: "fingerprint received and case resumed".

Really no clue what to do. The lawyer mentioned that if we did not got response for the first fax inquiry then we may file the second level inquiry in 15 days (second level sounds more promising it gives me a feeling reaching higher level). However since we received the response we could not file second inquiry.

"case assigned to an officer", does anybody has any clue time table for this. From the thread posted here it could be several month or even longer.

Is there any way to check the current status for case after "assigned to an officer" for let's say more than 30 days?

My lawyer says that INS does not give monthly updates nor are they required to do so. He asked me to wait patiently
since my case is in final processing, further inquires, though still an option, may not reveal anything nor even be responded to. So, basically that means I'm screwed. I can't do anything now, but wait patiently. Another option is going through some senator.

Anybody has idea how effective to contact a senator? Also since we received the "assigned to an officer" I guess we are supposed to wait a significant period of time before we contact senator.

2001 waitings,

I got 2 fax replys of "case is currently with an officer awaiting for adjudication" last month, handwriting from same person. I still wonder what's that mean, has been assigned to an officer ? waiting for assigning to an officer? or just standard reply language ? any body can tell me how long usually I need to wait for ?
 
I think this is a standard reply from INS just to save their sorry bottoms (as the JIT report suggests completion of all 01 cases). I would have believed them, if they had given the assigned date.
