W2 could be a problem!!!

Hi ,
I am posting for this my friend.She came to US 6 yrs back.now her I485 is pending.One of her big concern is that after reaching US she was not able to work for that year.so her employer didn't give W2 for that year.next she moved to another company and got job.from then she was continiously working.she has all other w2's.Is this could be a problem?I herd that they may ask w2's only for previous 3 years.Any advice appreciated...

Considering that IRS will not provide W2s or tax returns going back farther than 3 years, they can ask - but they will not get them.

That's not correct. I requested and received full copies of my 1999 and 2000 tax returns from the IRS in the fall of 2004 (the kind you have to pay a fee for) and I received them, complete with photocopies of all attachments, including W2s.

It's very doubful the USCIS would want to see a 6+ year old W2. The only thing they might be looking at that far back is a consistent record of lawful presence (visas, sequential I-94s, etc.) to show that at no time was your friend out of status.

Maybe I have it confused with the free stuff, because when I asked for my 1999 transcript in 2004, IRS refused to give it to me, saying it was too long ago.

Yes, I think I had an issue when I applied for the free transcript version. That's why I ended up having to request the paid version. It took them a couple of months to find and photocopy everything. They must have a hell of a warehouse somewhere!
