Voluntary Departure

Hello, i am an 18 year old student who will graduate from high school on June 9th. My 18th birthday was just this April which means that i have only been out of status for around 3 weeks. I came here legally when i was 13 years old, but a year after the cutoff date to be eligible for DACA

I want to leave the U.S, to go back to my home country and study in college without any trouble. I want to apply for Voluntary Departure, and arrive before June 1 which is the registration date for the university in my country. Missing this date would set me back a whole year. I have already attained permission from my school to leave early and I have the means to pay for my airfare.

The remaining problem for me, is the actual process of acquiring Voluntary Departure. I have had preliminary phone calls with ICE agents and they informed me that in applying for Voluntary Departure, that I would be most likely held for processing and detention for around 2-3 weeks. I would ideally apply for voluntary departure AFTER graduating, but the June 1 deadline for applying to my University prevents that, which means that I will have to apply soon, so I will be able to arrive by June. If I do get detained for 2-3 weeks, during the school year, I would not be able to eligible to graduate because of the amount of school time that I would miss which further confuses my time frame with regards to applying for Voluntary Departure

Would anyone be so kind as to clarify the steps required to get Voluntary Departure, and the possibilities of being detained. I have read that I could post a bond during the processing so that I would be able to continue going to school and graduate but the literature so far has been vague.

Thank you for your time and your advice.

An alien allowed to voluntarily depart concedes removability but does not have a bar to seeking admission at a port-of-entry at any time. Failure to depart within the time granted results in a fine and a ten-year bar to several forms of relief from deportation.

Why would you need Voluntary Departure? It looks like you will have just a few weeks of illegal presence, no bars kicking in.

Thank you for your reply TheRealCanadian.

Because of my sensitive time table, I can't be detained by Immigration for even a few days. If I buy a ticket and attempt to go back to my home country, I will be detained by ICE for an unknown period of time simply because I have overstayed even one day. This happened to my mother who had already bought her ticket but was forced to miss her flight because immigration officers detained her for a few days.

As far as I know, I am unable to travel back to my home country without going through a possibly long immigration process that will leave me unable to make my deadline to register for university. I was hoping that getting a voluntary departure order will allow me to smoothly travel and fly home without any risk of detainment.

Thank you for your time
