Visas with Two companies

Hi, I have a question for a friend of mine: Say he has a petition cleared with a company A and that was stamped on the passport. Now, after that he changes the company and joins company B for which he gets his petition transfered. The stamping is still valid for around 2 years. He can use the same stamping till the expiry is true, but if the company A cancels his visa, then, is the stamping valid or he has to get the revalidation done with the new company??

---That is true and should also show his new H1 approval notice at POE so that he gets new I-94 till the validity of new H1 approval notice

but if the company A cancels his visa,

---- Company can only revoke H1 petition NOT Visa stamp
then, is the stamping valid
--- Visa stamp is valid if he shows new H1 approval at POE
or he has to get the revalidation done with the new company??

---- he can do the Visa revalidation only if Visa stamp is expiring in 60 days

It has two different dates:
* Exp. date: FEB-03-2009
* PDE: OCT282005 - i.e. my H1 expiration date

What does both of them mean?

2. If I change the company now and want to travel before my H1 is approved with the new company, what do I do at the POE?

3. If I change the company and want to invite my parents here what should I use? (they ask for I-797).

* I have I-140 approved, I-485 filed for more than a year and have EAD. AP not yet approved filed in Nov. 03.

------- If you file H1 transfer then you can go out and return back with passport Visa if your H1 is approved while you are out of US then ask lawyer/employer to mail you the approval notice and at POE you show the H1Vsa stamp AND new H1 approval notice and you will get I-94 validity till H1 approval notice. If you come back to US before H1 transfer is approved then the I-94 that will be attached with H1 transfer approval will be your latest I-94
3. If I change the company and want to invite my parents here what should I use? (They ask for I-797).
---- Your current h1 approval, copy of I-94(both the sides) copy of all the passport pages, 1-2recent bank statements, 2 recent pay stubs, copy affidavit of support I-134 and invitation letter. If it is Mumbai US consulate then also send the copy of your birth certificate. Your documents don’t grantee visitor visa will be approved all depends on parent papers or ties to home country

----- you are safe to use AC21 and can join any employer with EAD or H1 transfer

About Question 3,

My H1 approval from the new employer will take 90 to 150 days. They have applied for normal processing.

So, can I send the H1 transfer receipt and may be my 485 receipt?

You are right, its my parents' tie in the home country that will matter the most..

--- Can this forum do something so that parents get guaranteed VISAs? I mean, it is easy to track people on H1, they can simply deport us if we have guaranteed their return and they don't return. Denial causes so much grief in the family and our hearts too..

One more question please, When a person transfers the H1 visa, then the H4 visas of his dependent also need to be transferred? even if the stamping is valid for longer time?

----H4 depends on H1 status, by law no need to file H4 transfer with your H1transfer but if you are filing H1 transfer and the extension date of your H1 transfer is going to be more than the H4 I-94 of spouse and your H1 is going to be filed beyond the I-94 date of your spouse then you may file H4 extension with your H1B transfer. You must ask they lawyer, if your spouse H4 I-94 is going to expire in 6 months then file her H4 with your H1b transfer because she will get new H4 extension approval with your H1 approval and you both will have same expiry date of I-94 and in future you will not forget to extend her H4 with your H1B. if employer is paying and ready to pay the lawyer for spouse H4 then file it if the lawyer says no need then just ask him that transfer may take 5-7 months what if goes out of US and her Visa stamp expires she need to get Visa stamp from out of US? if her H4 expires before you get H1 transfer approval notice comes what she will do? if lawyer/employer agrees file it
