VISA stamping in Chennai consulate..Help needed..URGENT

I revalidated my visa with H1B of company 'A' in 2001.Visa is valid until December 2003.
The company 'A' was merged with company 'B' at the end of 2001.My H1B is transfered to the new company 'B'.
I did not send my H1B for revalidation as it is valid until 2003,DEC.

My wife and son joined me(in usa) in 2001 with company 'A' stamp.Now they do not have H4 on company B.


Now we are planning to go to India in the next week.

1.Do I need to go for Visa stamping?

2.Do My wife and Son need visa stamping with the new company 'B' in Chennai,India.

3.company 'B' is processing my green card.and filed I-140.
Any problem if I say YES to the item#31(HAS ANYONE EVER FILED AN IMMIGRANT VISA PETITION ON YOUR BEHALF?)..

Please clarify me the above ASAP...

1. It will be better to get the h1 alongwith the H4s. Will take the same anount of time for all 3 passports to come back with the stamp.

2.It is better to get a stamp. However AC21 allows a person with H visa stamp (expired) to come into US with a new H1 approval. Such candidates might be subjected to secondary inspection (on account of inexperiences POE inpectors or applicants who do not know what AC21 entails) which is a hassle.

3. No risk.

In your answer to my query#1, You have mentioned that it is better to get stamped with the new company 'b'

In your answer to my query #2, You have said "No risk' if I come back to USA without stamping based on h1-b of the new company when my old company 'a' visa is valid until dec 2003...

Your visa stamp on your passport from company A continues to be valid until it's expiration. You do not need another visa stamp on your passport until that time.
Your wife's and son's H4 visas are also valid, provided it has not expired.

You or your family members do not need new visa stamping.


Remember to carry with you the original approval notices for your current employer when you travel outside US. It will also help to carry a current letter of employment from your employer.

No problem if you answer YES to question #31 in DS-156.

H visas are dual intent visas.

I am goin to chennai to get my h1 revalidation?? Please let me know whether there is any problem if I say YES (My company will file for i140 next week) .. I will be going to India during feb last week.

Please let me know if is answer YES is an ineligibility for H!B

A YES answer to that question does NOT make you ineligible for a H1 visa. H visas are considered dual intent, i.e. H visa applicants can hae the intention to seek permenent residency in the US and this intention cannot be a reason to reject H visa application.
 
I have mentioned 'YES' for the item #31.
I had been to Chennai in November and Stamping was over successfully for myself,my wife and for my son.
