Visa Approved / Extension of stay rejected

Hi Everyone,

My last day of termination of my previous employment was 31st March 2003. I was offered a new job on the 3rd of April by another company which I accepted. My visa application was sent on the 16th by my new company and recd. on the 18th by the INS. After about 6 months of wait, the INS sent an RFE which asked for the last 3 pay stubbs and a letter of termination showing exact date(from my prev. employer). I sent the same and my visa was approved but my extension of stay was not approved.

Has anyone exp. the same. Is it very common now-a-days?? What should I do now??

The INS has mentioned that they shall be sending a letter detailing the reasons. I am planning to wait for the letter before deciding anything on going back. is that a good idea???

----- You have to go out of US and get H1 visa stamped in your passport then enter US and get new I-94 at POE. Reason for this is that at the time of H1 Transfer filing you did not had recent pay stubs and the new company lawyer or the employer did a mistake as they filed H1transfer on 16, it is only gap of about 20 days when you are considered out of status by BCIS and they did not attach the extended I-94 with H1 transfer approval. Mistake of lawyer and employer they could have sent early generally 5-6 days period is forgiven.

---- I think you know the reasons I would go out and get the H1 visa stamped and will take all the required documents to get H1 visa stamp from consulate. From your name I think you are from north India Kaka Sardar Gurdeep Singh ji Maharaj and your consulate in India seems to be Delhi I don’t see problem in Delhi or Bombay it is Chennai that create problems and need truck load of documents.

ur comments may be right. I am planning to make a visit home soon with all the necessary documnets. Yes my counsulate is delhi. Thnx for your suggestions.
