I am not sure if you were in Rajiv's conference call this morning. You should always apply in your head office's place. If its in Virginia, then it shud be applied in Virginia. Its like a thumb rule.

I just got of the phone with company's attorney and his plan is to start RIR for me but through California (not Virginia where I work), sit in line for 3 years, receive rejection - And then file through PERM

How sound this plan is?

Since I belong to a very small European country I was hoping to apply RIR through Virginia, get 7th yr extension and most probably either convert to PERM or apply fresh PERM ....that way I can speed things up - and apply concurently as soon as PERM is processed.

With the option company's lawyer offers I am not sure I want to use the guy at all.

Can someone comment this thing please...

RIR and Regular in one queue

01/21/2005: DOL Backlog Reduction Processing Update

The DOL did not disclose in details a number of issues in the PERM Briefings which the consumers were interested in. It turned out that some of these issues had been discussed with the AILA in telephone conference before the PERM Briefing sessions began. Some of these issues had been answered as follows:
Status of Processing at the Backlog Processing Centers:
The cases which were transferred from the Regional Offices were processed first. For these cases, initial letters have been being sent out. Once the responses come back from the applicants, they will start adjudicating the cases. The current state is as follows:
Dallas, Philadelphia, and San Francisco Regions Cases: Data entry for these cases has been completed and letters have been sent out and the Backlog Centers are awaiting the responses for further processing and adjudication.
Chicago and Atlanta Regions Cases: These cases have been transferred to the Backlog Centers later and currently being data-entried. Once the data entry is completed, letters will be sent out the applicants as it did with the Dallas, Philadelphia, and San Francisco Regions cases.
The cases which were transferred from the SWA (state offices) are at the stage of data entry. Once data entry is completed, the same steps will be taken as described above.
Processing Queue per FIFO: Shockingly, there are no separate queues between RIR and Regular cases and both RIR and Regular cases are being processed on FIFO in a single national queue. Consequently, RIR cases will experience a substantial delay once the cases are transferred to the Backlog Centers!!
Opened Cases vs. Unopened Cases: Under the Transition Guideline, unopened cases have been transferred to the Backlog Centers and opened cases will be completed by the SWAs. The definition of "opened cases" is the application packages which are at the SWAs in unopened boxes or where no letters have been issued by the SWAs to the applicants. Accordingly, those who received a letter from the state offices may be completed at the state offices rather than being transferred to the Backlog Centers.
Notification of Address Changes of the Applicants or Attorneys: If one knows that his/her case has been transferred to the Backlog Centers, the notification should be addressed to the Backlog Centers. If one does not know, DOL suggests to such notification to both the Backlog Center and the SWA office.
Address of Certifying Officers and SWA in the Notice Posting for Cases to be Filed before 03/28/2005: People should follow the same rules and requirements under the current labor certification regulation. Thus the notice posting should direct the public to file misrepresentation or complaints to the office of Certifying Officer's office and the state labor certification unit. Remember, though, some Regions, addresses have been changed: Chicago and Atlanta offices.

this is messed up. that means all the hardwork for advertising needed for RIR is gone waste. this labor processin is getting rediculous day by day
 
shouldnt the companies sue the DOL? they spend money on a long-drawn recruitment process in accordance with DOL's published rules, hiring lawyers to properly do all the work, and then DOL plonks the RIR cases in a general queue wasting all that?

i agree, but then, there lack of initiative from industries in this. i dont think lawsuit is even required(which is bound to fail...) but at least industries can voice their concern. that might work.
 
Master Tracker

Hello all,

I am trying to create a master tracker that will help all of us determine where we all fall in the BEC queue.

My goal is to consolidate into a single tracker all pending labor certifications from all STATES and all DOLs.

This will help us in the long run to better understand how BECs will be processing our cases.

I have attached an empty tracker. I will return next Friday, February 11 to “pick it up”.

At that time I will merge all sub-trackers into a single one and post it in the DOL forums section.

I hope you find value in doing this and participate. If your forum has a tracker already, it would be great if someone volunteers and populates the tracker I have posted.

Since it will be hard for me to check all forums next week, if you have any questions, please send me a Private Message.

Any one has latest status on labor filed in VA? Looks like my case which is files on November 5th 2003 is shipped to BEC. Don't have any idea on when my company will be receiving 45 day letter.

Just called VA SWA

As per the lady, all 2003 cases have been transferred to BEC. Anyone has received love letter yet? Any other update for VA cases?

My lawyer received the 45-day letter from the backlog center in Feb and replied immediately. Does anyone know how to track the backlog center processing.

It is good to know that all 2003 cases are shipped to BEC. So my case should have gone there too since mine was filed in 2003 November.

Any idea on how soon we will receive a 45 day letter once the case reach bec?

Nope, no one knows. They are sending them in random order. Just have to wait and watch.
 
Lets poll

Guys,
Just for our knowledge can we have a poll conducted here wherein everyone can have a choice to select whether they'll be continuing with their BRC/BPC processing or will they be opting for PERM?
If polling is not possible, then lets just eveyone post a single line message about their intent. Atleast we'll have an idea of what the trend is.

45-Day Letter Received? VA Priority Date 11/03/2003

Hi all,

My lawyer says that he has received and as responded back to the 45-day letter! I think he is lying for some unknown reasons! My case details are as follows and I would appreciate if you could take some time to answer the following questions:

Case Type: RIR
State: VA
Priority Date: 11/03/2003
Case did not make it to regional (unopened case)

(1) Considering my priority date, is it possible that my lawyer has received the 45-day letter?

(2) What does a typical 45-day letter contains? a scanned copy of the 45-day letter would be a great help (ofcourse you can hide your personal information)

(3) Lets assume that he has received and responded back to the 45-letter. How to track the status of my application? I tried to send an email to Philly email address that is used for tracking and they told me that they don't have information on my case yet and I should contact my employer! should I try again to send an email?

I know none of us is a lawyer but your advice based on your personal experiences would be really helpful and highly appreciated.

Hi all,

I need a big favor. Do any of you know a good consulting co in VA within 40 miles radius of Manassas.

You see I also work for a comsulting company in Virginia. My employer is planning to close down the company and I am in the midst of GC process :( . EB2
rir 2002.

I checked with my lawyer and he says that since my labor has not been approved, I can transfer my LC to a new company but it needs to be in VA

I have a long term client who will be willing to sign contract with new consulting company. Can you recommend to me your company. I do not live in VA so it is very difficult to find consulting co in VA over the net.

As I am in a time crunch, I would really appreciate your timely respond... I am sending out as many request as possible. A name, contact no. and a website is all I need.. I can call them to work out the details. Please send me pm.
