Hello Folks,
Long story short...
I applied for my GC on June and the USCIS processing date for my I-765, I485, I864/864A were June 21st.
On July 7, I received a Ref for I-864/A stating they need a copy of citizen ship. The received the proof of US Citizen ship of the I-864A on July9.

I am working on my OPT now, and it will expire on August 31st. However, my wife will deliver a baby this week (Hopefully), :D.

At work, they told me by August 31st, if I don't have a work permit, I have to leave my work.

I requested an appointment with the Infopass tomorrow (At 9:00 am) to see if they can expedite my work permit for humanity reason.

Any advice or any information about my case???

Please let me know.

Regards,

Ayman

I would pickup the phone and talk to an immigration lawyer. Don't wait...you could loose your job. btw Good luck on soon to be a father

I could be way off here, but I thought I recalled something about there being a minimum 90 days between filing I-485 and being able to get EAD.

no, it's not a minimum. I got my first one within a month, and my second one after 2 months. There used to be a rule that you could get an interim EAD on the 91st day if you didn't get a regular one within 90 days, but it seems that local districts refuse to issue one nowadays.

Ask your employer to write you a letter (directed to USCIS) saying that if you dont have your EAD by a certain date you are out (this is important). Then take that and proof that your wife is about to deliver to your DO. They might consider your case. It works in some cases. Depends on who you talk to and how you plead your case. G' luck.

Thank you very much ....

Thank you very much for all your concerns as well as your replies.

I did every think I could do. I took an email from my employer, and my wife was with me, and I also took a letter from her doctor.

All of these didn't work. She said you have to contact USCIS regarding this. After that, she said let me make a copy of this receipt and I will send it to the National Service Center and see if they take it into consideration.

After I came back from the DO, I called USCIS and they told me I have to send a letter for them stating my case and they will look into it.

Any suggestions??? !!!! It is very critical and complicated case, and I heard from some people that they got it after 50 days and other got it after 80 days.

Who knows !!! Every thing happen, happens for a reason.

Regards,
Ayman

it is kind of useless to contact your local district for that, because EAD is not pending at your local district. I'd write to the place where it's pending.

I would also contact my congressperson and ask to speak to the immigration liaison there. Again there are no guarantees but sometimes they are able to persuade people at CIS to move cases forwards in the line. All you can do is keep trying. I was out of an I765 for 2 months last year so I know how you feel, mine took 4 months to process and it was hell waiting.

Ah yes, that sounds familiar. Thanks
